Dear Janice,
I would not go by the aide's statement exactly-I mean I would find out for
sure, in writing if the principal indeed said that. GET IT IN WRITING 

I would write a nice letter making it seem there seems to be some
misunderstanding. You could state what has happened in the order it did, the
facts so...
1> did Ari first say soemthign that indicated her confinement?
2 then you took her to the playgournd to confirm?
3 you then called the aide for confirmation?
4 she confirmed and said the reason was and put his statement in "quotes" as
she quoted him
5 you are writing to discover if his statements are accurate
6 you are concerned there may be a misunderstanding of Ari's capabilities
and the true coverage of the district's liability and the responsibility of
the district to not discriminate under IDEA (her right to LEA and access to
a FAPE as other children have) and under the ADA. 
7 You look forward to him clarifying what apparently may be his personal
"policy" of restricting her on the playground because of her blindness is
accurate or not.

He will likely drop the ball and it can save him face to say it was some
misunderstanding. IF he keeps on and says yes she can not because of
insurance we can help you take the next step. Or if she continues to be
restricted in any way.

We had a school try this once when we wanted industrial arts class for
Jordan to be done while he wore sleep shades. We discovered that districts
have to have a broad liability for all students-it is one cost, and having a
student participate who has disabilities does not add one penny--they are
already included as all students are for some risk. It is a bogus claim and
he does not understand their insurance likely.

I just found out that Ari has been "confined" to "the bar" at recess.
Imagine her surprise (and mine) when we took her to school playground and
found all the other equipment. She had a blast. Now my dilemma-i called her
aide and she said the principal was worried about the liability to the
school and wouldn't let her play on the equipment during school hours.   I
need your help in remaining objective and diplomatic because "the momma
bear" in me wants to eat him for lunch. Your comments are welcome. Janice
