About the Position: Under the supervision of the Deputy Center Judge Advocate, this position works with a legal team consisting of two paralegal investigators to investigate and process medical malpractice claims filed against the Madigan Healthcare System under the Federal Tort Claims Act. Also coordinates litigation when claims proceed to lawsuit. Serves as the alternate medical law and ethics advisor to Madigan Healthcare System staff on administrative and fiscal law issues.

As an Attorney, investigate legal aspects of adverse patient outcomes including those resulting in personal injury or death of the patient and medical malpractice claims. Interview potential witnesses (including health care providers, claimants, and families) to assess liability and damages. Locate subject matter experts to review records and evaluate standards of care issues. Advise senior leadership on the disposition of claims. Negotiate with claimants¿ attorneys, draft settlement memorandums, and obtain independent medical evaluations of claimants to settle malpractice claims. Ensure adverse patient outcomes and medical malpractice claims are reviewed by the Risk Management Committee. Perform legal research and analysis, formulate conclusions, and make recommendations for litigation of cases. Prepare cases for trial by participating in pre-hearing conferences, presentation of motions, and preparing briefs and other litigation documents. Serve as alternate ethics advisor.

KSAs: 1. Evaluate medical malpractice claims through research, conducting interviews, and use of experts to determine liability and damages. 2. Apply healthcare law to the evaluation of medical cases to determine disability ratings and present determinations before the judge. 3. Provide clarification of laws, regulations, and rules dealing with standards of conduct and conflicts of interest to ensure compliance with ethics programs. 4. Prepare litigation reports and legal documents outlining the facts and legal issues involved to justify recommendations and conclusions.

*  Time in Grade Restriction: Applicants currently employed as an attorney by the federal government must have completed one year of time-in-grade at the next lower grade level within 30 days of the closing date of the announcement, or previously served at the same or higher grade as the position being filled.

*  Education: An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).
*  Bar Membership: An applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.
*  Experience: For GS-12/13 or equivalent - Applicant must have two or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience.
