Ortiz of the District of Massachusetts announced today that they have entered into a consent decree with HRB Digital LLC and HRB Tax Group Inc., subsidiaries of H&R Block Inc., to remedy alleged violations of the Americans with Disabilities Act (ADA). The decree resolves the department's allegations that individuals with disabilities are denied full and equal enjoyment of largely tax-preparation focused goods and services that are provided through H&R Block's website and mobile applications. The decree has been filed with the U.S. District Court for the District of Massachusetts for the court's approval. On Dec. 11, 2013, the Civil Rights Division and the U.S. Attorney's Office for the District of Massachusetts filed a complaint in intervention in the lawsuit National Federal of the Blind (NFB) et al. v. HRB Digital LLC et al. to enforce Title III of the ADA. The decree resolves the complaints by the NFB, two individual plaintiffs and the United States filed in the District of Massachusetts. H&R Block is one of the largest tax return preparers in the United States. It offers a wide range of services through its website, www.hrblock.com, and its mobile apps, including professional and do-it-yourself tax preparation, instructional videos, office location information, interactive live video conference and chat with tax professionals, online and in-store services and electronic tax-return filing. The complaint alleged that H&R Block failed to code its website in a manner that would make it accessible to individuals who have vision, hearing and physical disabilities. As described in the complaint, individuals with disabilities use various assistive technologies to access the Internet, including screen reader software, refreshable Braille displays, keyboard navigation and captioning, among others that are not currently compatible with H&R Block's website. These technologies have been widely used for decades. The recognized international industry standards for web accessibility, known as the Web Content Accessibility Guidelines (WCAG) 2.0, can be found online and are freely available to help companies ensure that individuals with disabilities can fully and equally enjoy their web-based goods and services. "This landmark decree ensures that individuals with disabilities will have an equal opportunity to independently and conveniently obtain information and complete taxes as others do," said Acting Assistant Attorney General Samuels. "H&R Block is to be commended for working with the NFB and the Justice Department in resolving to take such steps." "For those with disabilities, an inaccessible website puts them at a great disadvantage and further perpetuates a feeling of dependence and reliance on others," said U.S. Attorney Ortiz. "With thoughtful and proper web design, businesses and organizations can have a great impact on the daily lives of people with disabilities who, like everyone else, seek to enjoy the benefits of technology." Under the terms of the five year decree, H&R Block's website, tax filing utility and mobile apps will conform to the Level AA Success Criteria of the WCAG 2.0. According to the decree, the H&R Block website will be accessible for the start of the next tax filing term on Jan. 1, 2015, with additional accessibility deadlines over the following years of the decree. Additionally, HRB Digital and HRB Tax Group have agreed to: appoint a skilled web accessibility coordinator who will report to H&R Block's enterprise Chief Information Officer; adopt a web accessibility policy; initiate training on accessible design for its web content personnel; evaluate employee and contractor performance based on successful web access programming; conduct regular automated and user group testing; and hire an approved outside consultant to prepare annual independent evaluations of Block's online accessibility. H&R Block will also pay $45,000 to the two individual plaintiffs, and a $55,000 civil penalty. An accessible version of the consent decree is available on the ADA website. 14-239Civil Rights Division From Noel.Nightingale at ed.gov Fri Mar 7 22:35:10 2014 From: Noel.Nightingale at ed.gov (Nightingale, Noel) Date: Fri, 7 Mar 2014 16:35:10 -0600 Subject: [blindlaw] FW: Attorney Vacancies at the U.S. Department of Justice In-Reply-To: <432b0208cbd340f484febe1e1be36454@BN1PR07MB310.namprd07.prod.outlook.com> References: <98A98D365DA17347B0FA3158D79B489447A7B1E1@DPRC-EXCH-P04.JCONMAIL.doj.gov> <432b0208cbd340f484febe1e1be36454@BN1PR07MB310.namprd07.prod.outlook.com> Message-ID: <04F1893C93758F4AA7CB436BB2675066011574FDEC77@EDUPTCEXMB02.ed.gov> From: Jobs [mailto:jobs-bounces at nfbnet.org] On Behalf Of Maurer, Patricia Sent: Friday, March 07, 2014 11:47 AM To: jobs at nfbnet.org Subject: [Jobs] FW: Attorney Vacancies at the U.S. Department of Justice From: Hunter, Sue (JMD) [mailto:Sue.Hunter at usdoj.gov] Sent: Friday, March 07, 2014 2:36 PM To: Hunter, Sue (JMD) Subject: FW: Attorney Vacancies at the U.S. Department of Justice Below is a list of current attorney vacancies at the United States Department of Justice. As many of you know, I am a blind attorney and the GP Solo Division has been one of the most welcoming entities within the ABA. I have had tremendous opportunities for leadership and meaningful input. Currently, I serve on GP Solo’s Council and am otherwise actively involved in the Division. The Division also, of course, has significant relevance for me because I am a solo. Note also that there is a fellowship program for young lawyers as well. If you have any questions about the program, please do not hesitate to contact me. Best, Scott C. LaBarre, Esq. Secondly, the new iWork applications from Apple have changed this. They are very accessible, and handle things like track changes, comments, footnotes etcetera much better than JAWS in MS Word. They can also open and save to MS Office document formats. The Mail, Contacts and Calendar applications are also much easier to use than Outlook and fully support Microsoft Exchange accounts. I think where VoiceOver and the Mac are lacking is in the accessibility of complicated PDF documents, such as those with tables and fillable form fields. This seems to be changing for the better, however. I am starting at a law office on Monday which has just switched to the Mac OS, so I'll really be able to put this to the test. So far it's working well. Creating court documents actually seems much easier on the Mac for me than with Microsoft Word, because fillable form fields in Word 2010 are not very accessible. I’m just curious, since I would like to be part of one of them in order to express my opinions about the Bill. Our IT folks said it ook a long time for us to transition to Windows 7, because they found some issues concerning accessibility of the operating system that needed to be worked out. Of rourse, our technology is not government issue, but owned and maintained by a contractor. And, I would guess that various components in different locations have other contracts, etc. I know the ED Department OCR at least had it's IT through Perot Systems, or whoever owns that company now. Ours is through Lockheed Martin, etc, etc. But back to the specific issue, Windows 7 here. /s/ Bennett Prows -----Original Message----- From: blindlaw [mailto:blindlaw-bounces at nfbnet.org] On Behalf Of Ronza Othman Sent: Wednesday, March 12, 2014 6:01 PM To: 'Blind Law Mailing List' Subject: Re: [blindlaw] MS Operating Systems in Federal Agencies Hi - I work for a federal department (same one as Ben, interestingly, but we don't follow the same operating system refresh schedule as Ben's part of the department), and we've been using Windows7 since mid 2012. At the Department of Health and Human Services you can give back to your community, state, and country by making a difference in the lives of Americans everywhere. Join HHS and help to make our world healthier, safer and better for all Americans. The Department of Health and Human Services is sponsoring a Senior Executive Service Candidate Development Program (SESCDP) which is targeted to begin in July 2014. We are anticipating a class size of 20-25 participants. The SESCDP prepares individuals who have demonstrated executive potential for senior leadership positions. Participants in the program engage in developmental assignments and formal training activities to enhance their executive competencies and to increase their awareness of public policy, programs, and issues. The program promotes the development of a Government-wide, as well as an agency-wide, corporate SES culture through exposure to ideas and concepts across Government, and ensures that HHS has a sufficient pool of well qualified and diverse candidates to meet present and future executive needs. Candidates who successfully complete the program and receive certification of their executive qualifications by the Office of Personnel Management Qualifications Review Board under the criterion of 5 U.S.C. 3393(c)(2)(B), will be eligible for noncompetitive appointment to the SES. Participation in the program does not guarantee placement in a SES position. TRAVEL REQUIRED · Occasional Travel · Occasional travel will include the one week off site orientation in Washington, DC. RELOCATION AUTHORIZED · No KEY REQUIREMENTS · U.S. Citizenship is required · Must be a current Federal Civil Service Employee · Application package must be received by closing date of the announcement ________________________________ DUTIES: Program Curriculum Length of Program: This is a 12-18 month, part-time program. Participants normally continue to occupy their regular positions except while they are attending training or seminars, or while on rotational assignments. Orientation: Participant will begin the program by attending the 1-week SESCDP orientation in Washington, D.C. During the orientation session, participants will assess their leadership skills; select mentors and develop their Executive Development Plans (EDPs). Individual Needs Assessment: Each participant completes a 360 assessment exercise prior to the orientation week, which is designed to determine those competencies which will be developed or reinforced during the program. Results of this assessment will be discussed individually with each participant during orientation. Senior Advisor (Mentor): Through their experience, proven capabilities, and management perspective, SES senior advisors assist participants in further clarifying their developmental objectives and in identifying developmental assignments and activities. Typically, candidates will meet monthly with their mentor to review progress on their EDP, but also to talk through situations related to their EDPs. Executive Development Plan: An Executive Development Plan (EDP) is prepared by each participant, together with the immediate supervisor and the senior advisor. The EDP is used to identify, track, and document completion of competency-based needs of the participants. It is approved by an HHS Executive Resources Board, and is updated or revised, as needed, throughout the program. Rotational Assignment: Significantly challenging rotational assignments totaling at least 4 months of full-time service are required of all participants. One assignment at the executive level must be at least 90 continuous days in a position other than, and substantially different from the candidate's position of record. These assignments must have executive level responsibilities and are designed to help prepare participants for the nature and scope of positions they are likely to assume in the SES. Interagency Training: The program requires at least 80 hours of formal interagency training throughout the duration of the program that addresses the executive core qualifications and their application to SES positions Government-wide. The training experience includes interaction with a wide mix of senior managers and executives outside the candidate's organization or agency to foster a broader perspective. HHS External and Internal Developmental Activities: Candidates participate in specifically selected external and internal training events, and other planned developmental activities and tailored management seminars which will be scheduled throughout the period of the SESCDP. These seminars and activities supplement the rotational assignment and the interagency training experience. Progress Review: Progress in meeting EDP requirements is closely monitored by the SESCDP Program Manager, senior advisor (mentor), and the Executive Resources Board (ERB), and is evaluated periodically to assure timely completion of program activities. Candidate Certification: After a candidate completes the program, the ERB determines if the candidate successfully completed all SESCDP requirements and demonstrated that he or she is prepared to serve as a member of the SES or if more development is needed. Once the ERB determines that a candidate has successfully completed the program, the candidate, in collaboration with the SESCDP Program Manager, prepares all OPM-required QRB documentation. If the ERB determines that more development is needed, it will provide the candidate with specific recommendations for additional training or development assignments necessary to successfully complete the SESCDP. ________________________________ QUALIFICATIONS REQUIRED: To be considered, applicants must meet the requirements described below by the closing date of the program announcement: Applicants must have 1 year of supervisory experience Applicants must have experience equivalent to the GS-15 in the Federal service Supervisory experience includes planning, assigning, and evaluating the work of subordinate employees. The experience you have using Windows XP should be plenty in my view. Windows7 is not as intimidating as most of us think; yes, without a doubt, there will be a need to do a few things differently, but I doubt if a particular scientific methodology is required in order to use Windows7. Windows7 Professional, which is what I think many of these agencies will install on their computers, can emulate XP should that become necessary although I seriously doubt that this will be the case. At work, I still run Windows XP Professional. Why? I want to see what will happen on April 8 when Microsoft quits supporting Windows XP. For example, will my work computer turn on? Will it have connectivity to the Internet? Will Internet Explorer 8 still work? If the answer to these questions is "YES", I'll leave things alone at work for a while perhaps till the end of the year. In the past, I had used Paychex. Their price became a slippery runaway and I had to cancel the service. Next, I turned to SurePayroll and processed payroll exclusively online. Initially, the process was smooth sailing! After a while, they got into using a lot of Java script and Flash and processing payroll online independently became a nightmare. What they did was that they assigned an employee to help complete the processing, but I still had to approve and submit it. No problems there! I left SurePayroll in part because they were not able to report and file the corporate and employee portions of the Occupational Privilege Tax (OPT) as required by the City & County of Denver. Paychex does want us back and have given us a deal that's hard to refuse! Sadly though, the Paychex Online website is packed full with Flash and is NOT accessible. Principled and nonpartisan, the ACLU has offices in all 50 states, Washington, DC and Puerto Rico, and brings together the country's largest team of public interest lawyers, lobbyists, communication strategists, members and activists in the advancement of equality, fairness, and freedom, especially for the most vulnerable in our society. The ACLU seeks applications for a full-time Staff Attorney to work with the ACLU's Center for Liberty, focusing on the Center's priority of ending the use of religion to discriminate. OVERVIEW The ACLU's Center for Liberty encompasses the ACLU's work on women's rights, reproductive freedom, LGBT rights and the rights of people living with HIV, and freedom of religion and belief. The Center for Liberty is dedicated to the principle that we are all entitled to determine the course of our lives based on who we are and what we believe, free from unreasonable government constraint and baseless stereotypes. The Center seeks an experienced attorney to take a leadership role on the Center's priority of combatting current efforts to use religion to discriminate, largely through a refusal based on religion to comply with anti-discrimination laws. These efforts take many forms today. In the name of religion, businesses seek exemptions to rules requiring them to provide insurance for contraception, inns and stores claim a right to turn away customers based on their sexual orientation, schools assert a right to fire pregnant women if they are unmarried, religiously affiliated entities receiving government grants assert a right to discriminate in hiring, and medical professions advocate for the right to deny referrals and care. The bundle of issues is often referred to as religious refusals. The position will afford opportunities for a strategic and creative attorney to take on significant responsibility to shape the Center's work on this important and cutting edge issue using litigation, the media, and legislation. The attorney will be part of a team addressing efforts to use religion to discriminate that includes litigators, state and federal advocates, and communications staff. The work also has an international component, supporting the ACLU's participation in the International Network of Civil Liberties Organizations, which includes civil liberties groups from ten countries. The ACLU, through the Center for Liberty, is unique in the country in addressing the question of religious refusals from the perspective of religion, LGBT equality, reproductive rights, and women's rights. While the position will focus on our work to end the use of religion to discriminate, the attorney will work on other Center priorities and issues as assigned, and will report to the Director of the Center for Liberty. ROLES AND RESPONSIBILITIES * Work with Center Director to develop and implement a multi-pronged approach to further the goals of the religious refusals strategic plan using litigation, public education, legislation, and policy advocacy; * Work closely with legal, legislative, communications, and advocacy staff to further religious refusals goals; * Engage in litigation in federal and state court, including drafting pleadings, briefs, and affidavits; * Conceptualize and prepare briefing papers and reports as necessary to further the program's strategic plan; * Write and produce the ACLU's monthly newsletter, Highlights from the Campaign to End the Use of Religion to Discriminate, as well as a quarterly international newsletter, Global Developments in Religious Freedom and Equal Treatment; * Advise and work with ACLU affiliates on relevant issues; * Monitor strategies of our opponents on these issues; * Foster relationships with other advocates, lawyers, academics, and clients as necessary to further program goals; * Engage in public speaking, including at conferences and in the media; * Supervise Liberty paralegal, assistant, and interns; * Travel as required for litigation, conferences, and development of the program. EXPERIENCE AND QUALIFICATIONS * J.D. degree and a minimum of three years' legal experience required; individuals with more experience are strongly encouraged to apply. * Ability to work creatively to use the law, the media, and advocacy to achieve social change. * Experience in a supervisory or leadership role preferred. * Flexibility to work in a variety of issue areas. * Commitment to Center for Liberty priorities and issues. * Superior analytic skills and excellent research skills. * Independence and initiative. * Demonstrated ability to write and to speak clearly and persuasively. * Ability to work with a wide range of people and foster a team environment. COMPENSATION The ACLU offers a generous and comprehensive compensation and benefits package, commensurate with experience and within the parameters of the ACLU compensation scale. HOW TO APPLY Individuals interested in applying should send a letter of interest, resume, legal writing sample, and the names and contact information for three references to hrjobsCFL at aclu.org. I have variety of eye conditions that in summary have rendered me legally blind. For about four years (2006 to 2010) I participated in "Blind / Low Vision Toastmaster's Chapter at the Oakland Blind Center in Oakland, CA sponsored by the Rotary Club. Our Toastmasters Chapter was composed entirely of persons who were legally blind, many were elderly a few were professionals and couple were totally blind). None of the Toastmaster materials were provided in large print, audio or braille. However, we took it upon ourselves upon receipt of the materials to convert the standard Toastmaster materials to large print or audio. I do not believe any of the materials were converted to braille. I highly recommend Toastmasters as a vehicle to promote public speaking, oral advocacy and self improvement for persons who have low vision / visually impaired or totally blind. The Toastmaster materials are really not that extensive and are only a guide. What is more important in my view is to have a group of blind individuals who take control of the Toastmaster activity and keep it going based upon their interest. Toastmasters International was very cooperative in supply materials such as they were, reducing or waving charges where they could and incorporating our group into the main body of Toastmasters International. Good luck . Google does have the feature of asking for transit or bus directions. I have tried it on occasion and it was readable with JAWS but I too have become more and more disgusted with Google and their poor excuses for accessibility. Message-ID: <3E86A9F3DC676742B192213CC4E9D4A213FE7D813C@PDC-MAIL02.jwllp.com> Mike - Here is what I do. 1. Go to your deleted items folder. 2. Select the email that you want to undelete, but do not open it. Just have your cursor on it. 3. Press the three keys all at the same time - CTRL SHIFT V 4. This will bring up a tree with all of your mail folders. The folder to which you last moved an item is selected. If this is not the correct folder, then move the cursor to the folder you want the email in; probably your INBOX. 5. Press the Enter key. This will move the highlighted email to the selected folder. 6. I always double check that the email is where I want it. NOTE: If the email didn't move to your inbox, then press CTRL SHIFT V which will bring up the tree and the highlighted folder is the last folder to which an item was moved. DO NOT PRESS ENTER. Instead press the Escape key so that you don't move another item. I have a visually-impaired daughter. She is also dyslexic. She is getting double time and will be able to use her CCTV during the Common-Core ELA test. Someone suggested that she should be given a reader (to read the questions at least). She has to read LONG passages, read the questions and often times it is required to go back to the passage and find specific details in order to answer the questions. Even at double time - this is most difficult for someone with a visual impairment on top of dyslexia. I think your daughter should be allow more time than just double time and that she also will need to have a reader for her test questions. In fact, I also think that she also needs to have a reader to read her the reading stories of the test as well since she could get tired in going back and forth in order to find a specific answer to the question. And when I say have areader to the stories, I mean she can telll the reader the parragraph where the answer of the questions could be since she read the story with her CCTV. You need to fight for her rights!! Have you tried to meet with the Principal of the school, her vision teacher, and the person in charge of the test and talk to them regarding this issue and letting them know that she really needs these accommodations in order to succeed in the test? Hope to hear from you soon. As long as you can justify the reasoning for the accommodation based upon her disability, she can receive the accommodation. It sounds to me like there is substantial justification for the accommodation of read aloud. As an example, I have put the read aloud accommodation for state & district wide testing for students who have attention issues (ie. ADD, ADHD)....not because they couldn't read but because someone reading to them helped them to focus and remain on task, which allowed them to show their true potential on the material. If the dyslexia is identified in her IEP, the accommodation could also be justified based upon that because that is a reading disability. So I absolutely see that the accommodation could be justified. Now, to what extent or what can be read, is another matter. There are rules that must be followed. Since I am not familiar with what specific tests your state is using, it is difficult for me to answer that question. Ohio is using PARCC. If for some reason that is what NY is using, I could give you further info. on it. Otherwise, your child's teacher should have access or know where to get access to find out the extent to which it can be read. If I can be of any more assistance, please feel free to contact me off list. Good luck! Nicole In a message dated 3/26/2014 7:03:49 P.M.
