Principled and nonpartisan, the ACLU has offices in all 50 states, Washington, DC and Puerto Rico, and brings together the country's largest team of public interest lawyers, lobbyists, communication strategists, members and activists in the advancement of equality, fairness, and freedom, especially for the most vulnerable in our society.

The ACLU seeks applications for a full-time Staff Attorney to work with the ACLU's Center for Liberty, focusing on the Center's priority of ending the use of religion to discriminate.

OVERVIEW

The ACLU's Center for Liberty encompasses the ACLU's work on women's rights, reproductive freedom, LGBT rights and the rights of people living with HIV, and freedom of religion and belief.  The Center for Liberty is dedicated to the principle that we are all entitled to determine the course of our lives based on who we are and what we believe, free from unreasonable government constraint and baseless stereotypes.

The Center seeks an experienced attorney to take a leadership role on the Center's priority of combatting current efforts to use religion to discriminate, largely through a refusal based on religion to comply with anti-discrimination laws. These efforts take many forms today. In the name of religion, businesses seek exemptions to rules requiring them to provide insurance for contraception, inns and stores claim a right to turn away customers based on their sexual orientation, schools assert a right to fire pregnant women if they are unmarried, religiously affiliated entities receiving government grants assert a right to discriminate in hiring, and medical professions advocate for the right to deny referrals and care. The bundle of issues is often referred to as religious refusals.

The position will afford opportunities for a strategic and creative attorney to take on significant responsibility to shape the Center's work on this important and cutting edge issue using litigation, the media, and legislation. The attorney will be part of a team addressing efforts to use religion to discriminate that includes litigators, state and federal advocates, and communications staff. The work also has an international component, supporting the ACLU's participation in the International Network of Civil Liberties Organizations, which includes civil liberties groups from ten countries. The ACLU, through the Center for Liberty, is unique in the country in addressing the question of religious refusals from the perspective of religion, LGBT equality, reproductive rights, and women's rights.

While the position will focus on our work to end the use of religion to discriminate, the attorney will work on other Center priorities and issues as assigned, and will report to the Director of the Center for Liberty.




ROLES AND RESPONSIBILITIES


*         Work with Center Director to  develop and implement a multi-pronged approach to further the goals of the religious refusals strategic plan using litigation, public education, legislation, and policy advocacy;

*         Work closely with legal, legislative, communications, and advocacy staff to further religious refusals goals;

*         Engage in litigation in federal and state court, including drafting pleadings, briefs, and affidavits;

*         Conceptualize and prepare briefing papers and reports as necessary to further the program's strategic plan;

*         Write and produce the ACLU's monthly newsletter, Highlights from the Campaign to End the Use of Religion to Discriminate, as well as a quarterly international newsletter, Global Developments in Religious Freedom and Equal Treatment;

*         Advise and work with ACLU affiliates on relevant issues;

*         Monitor strategies of our opponents on these issues;

*         Foster relationships with other advocates, lawyers, academics, and clients as necessary to further program goals;

*         Engage in public speaking, including at conferences and in the media;

*         Supervise Liberty paralegal, assistant, and interns;

*         Travel as required for litigation, conferences, and development of the program.

EXPERIENCE AND QUALIFICATIONS


*         J.D. degree and a minimum of three years' legal experience required; individuals with more experience are strongly encouraged to apply.

*         Ability to work creatively to use the law, the media, and advocacy to achieve social change.

*         Experience in a supervisory or leadership role preferred.

*         Flexibility to work in a variety of issue areas.
*         Commitment to Center for Liberty priorities and issues.
*         Superior analytic skills and excellent research skills.
*         Independence and initiative.
*         Demonstrated ability to write and to speak clearly and persuasively.
*         Ability to work with a wide range of people and foster a team environment.
