Sometimes, even local law firms will have scholarships for particular groups of individuals (I.e. Women, racial/ethnic minorities, persons with disabilities). The only problem with many of these scholarships is that the scholarships are often small – The largest I've seen was $5000, but most that I've seen were $2000. They don't help out very much, especially when you consider the fact that you're dropping over $20,000 a year on tuition alone. This only, many of the applications require a lot of a person and can take a lot of time. There's not much spare time lying around in law school. If your grades have improved since the school gave you their scholarship, you may be able to ask them to reconsider the amount of your scholarship, if it is a merit-based scholarship. You just never know where jewels like this may lurk, but there is usually and administrator who does. Title III of the ADA, which covers access to businesses, has traditionally been applied to brick and mortar establishments to ensure that, for example, people in wheelchairs can enter. But as consumers have moved online, the law's focus has expanded. The Department of Justice, which is responsible for implementing the ADA, is increasingly reviewing websites to determine whether they comply with the law's access requirements. At the same time, a growing number of plaintiffs are filing lawsuits alleging that various business websites are inaccessible. Internet companies, including Peapod and Netflix NFLX -1.4%, have settled cases that alleged their websites were inaccessible to people with visual and hearing disabilities. And, in June, the Department of Justice may finally issue long-delayed proposed regulations that address websites. But until clear regulations have passed, business owners will face uncertainty as to what the ADA requires. To better understand how business websites can avoid running afoul of the law, I spoke with Lynn Calkins, who leads Holland & Knight's litigation group in Washington D.C. A Braille reader that helps blind people access the Internet. (AP Photo/Frank Eltman) Adriana Gardella: Why is the Department of Justice focusing on websites now? Lynn Calkins: The DOJ first proposed a rule to address the ADA's applications to websites in 2010, after it realized so many people were shopping online. But the effective date of the rule keeps getting pushed because of the widespread implications. Gardella: Do we know what types of business websites will have to comply with the ADA? Calkins: Businesses that provide products or services to the public through their websites are covered. But beyond that it's not yet clear. Court decisions have been inconsistent. For example, the ADA has been applied to websites in cases where a brick and mortar store had a website-the argument was that the ADA applied because there was a brick and mortar store. But it has also been applied in situations where there is no brick and mortar store-as cases against companies including Netflix demonstrate. Gardella: Must a business be a certain size before its website must comply with the ADA? Calkins: That's also not clear yet. But in its Notice of Proposed Rulemaking, the DOJ requests comments from the public on issues including whether it should take an 'incremental' approach to adopting regulations. For example, should the regulations first be applied to entities with 15 or more employees, or to those with a certain amount of revenue? Gardella: What sorts of website issues have gotten businesses in trouble? Calkins: Typically, problems arise when certain website features are hard to use or incompatible with an assistive device that a person with a disability requires. Assistive devices include things like screen reader software, voice interactive software, and Braille output devices for the visually impaired. Another example would be closed captioning that doesn't readily pop up. Companies also can't require a disabled person to take an extra step to get a product or service-for example, by telling them to call if they need help. And it's not enough for a company to roll out new webpages that comply with the ADA, they also have to be sure the old ones do. Gardella: How can a business's assess whether its website is ADA-compliant? Calkins: In its settlement agreements, the DOJ mandates compliance with the recommendations of the United States Access Board, a federal agency that promotes equality for people with disabilities. So, before a business faces a lawsuit or a DOJ compliance review, it should hire a web consultant who is familiar with those guidelines. Gardella: What are the penalties for companies whose websites fail to comply with the ADA? Calkins: The maximum penalty the DOJ imposes for a first violation is $75,000. For subsequent violations, it's $150,000. But the question always is, 'What constitutes a first violation?' For example, is each page a separate violation? The bigger issue is the size of any civil penalty. Canadian legal team looking for U.S. research to challenge municipality scope of powers and preserve grizzly bear and wildlife habitat from proposed ski development. I imagine there have been some company towns in the US (Dow Chemical towns), and wonder if there is any law regarding when these company towns are actually granted full municipal status (immediately; or after a more stable population arrives?); (ii) Any helpful caselaw respecting the actions of a public authority being contrary to the stated purposes of a statute. There are various statutory interpretation terms that account for judges reviewing actions that do not comply with the stated purposes of the statute. I'm very interested and will of course be happy to preserve confidentiality, as required. Rod, I haven't myself done this as I'm newly qualified and anyway Irish civil procedure does not have anything quite akin to the American deposition. However, it seems to me that any lawyer (blind or sighted) will want access to such material before the hearing, so that they can prepare their examination of the witness, whether that be in chief or in cross. Otherwise, there is a risk that the lawyer will be taken by surprise and may fail to adequately obtain client's instructions (or guidance from experts, if appropriate - as where the diagrams relate to technical subject matter for example). I therefore wonder whether there is some means under the applicable rules, by which you can obtain the material prior to the deposition? Failing that, I wonder whether an application could be made to Court - I do not see why one should be reluctant to rely on one's disability for the purpose of obtaining material in advance. However, I've worked at the Connecticut Attorney General's office for the last year and have been to two depositions where we have presented complex mathematical calculations in a residential mortgage backed securities underwriting case based on violations of the blue skies laws. The response we often got the first time we just dropped it on the defendants was that they'd need to get back to us once they'd had a chance to look at the data in more detail. The next time we had a deposition with this bank, we told them in advance that we'd be discussing numbers and they asked us to provide them in advance if they wanted a meaningful dialogue about them at the deposition. I'd imagine that talking to the other side and letting them know that if they have any material like you described and weren't planning to share ahead of time, that your client would not be able to discuss the relevant evidence until you've had a chance to look at it in an accessible form/had someone in your office look at it. Just my very new and humble opinion. There were a couple little finicky things, like how focus would sometimes jump back to the beginning of the question when I was going through the answers, but no real issues. The main ADA team at Barbri is great, and will help you however they can. They are tracking the accessibility of that program in particular pretty carefully. Or at least, they were last year. But also, rather than making sure you can do every inch of the Barbri course, I would advise you, as Barbri will half way through the summer, that your focus should be on the outlines from the lectures and doing actual exam practice questions.
