Greetings everyone, below is a link to an NPR story about a case going to
the Supreme Court today for oral arguments. It addresses a school's refusal
to allow a girl with CP to bring her service dog to school. The legal issue
at hand is whether one must go exclusively through the Individuals With
Disabilities Education Act to pursue any kind of discrimination related to a
student's education. IDEA has extensive administrative hurtles to jump
through and does not offer the same level of legal relief as the ADA and
other statutes. With the Court still only at eight members etc, it will be
very interesting to see how this case turns out.
