If these questions are not appropriate for the email list, perhaps I can receive responses from people off list rather than continuing this thread on the email list. Anyway, I am currently attempting to write a complaint against my college disability's office and the current 504 ADA Coordinator using the complaint process within my college regarding the lack of accommodations I received this semester for a math class. Since I do not know Braille very well, or know how to make a screen reader read math symbols or the charts and graphs that are used for my math class, I chose to use a reader for my math class. However, it appears as though my college and I disagree on what constitutes as a qualified reader, and I was forced to drop my math class because the reader I was provided was not proficient in reading math materials to me. I have tried searching online to see if I can find any information or settlement agreements that can help provide clarification as to what constitutes a qualified reader without much success. However, I believe it may be helpful to include this information in my complaint. Although, I am not completely sure as I am not quite sure how to write such a complaint. But anyway, if anyone here on the email list could help provide clarification as to what constitutes as a qualified reader, I would greatly appreciate hearing from you. Shannon Ramsay was a longtime member and good friend to many in the National Federation of the Blind of California. In fact Shannon received a national scholarship many years ago and went on to earn a law degree. She was only 36 years old. Apparently, she had some kind of anifilactic shock response to pneumonia and collapsed on Wednesday. I have only sketchy information at this time. I will let everyone know about funeral arrangements as soon as I receive it. From paulharpur at gmail.com Tue Mar 28 10:27:28 2017 From: paulharpur at gmail.com (Paul Harpur) Date: Tue, 28 Mar 2017 20:27:28 +1000 Subject: [blindlaw] Discrimination, Copyright and Equality: Opening the Ebook for the Print Disabled Message-ID: On 30 March 2017 my latest monograph, :”Discrimination, Copyright and Equality: Opening the Ebook for the Print Disabled”, will be released in Europe and the UK. It can be found on the Cambridge University Press website: www.cambridge.org/9781107119000 This monograph contributes to disability rights scholarship and legal advocacy. It analyses the interaction between anti-discrimination and copyright laws, in the international human rights and copyright jurisdictions, as well as in the national jurisdictions in Australia, Canada, the UK and USA. This work builds on international and domestic notions of digital equality and rights to access information. The core thesis of this monograph is that technology now creates the possibility that everyone in the world, regardless of their abilities or disabilities, should be able to access the written word. Why then is there still a book famine where 5% to 7% of the world’s books are available to people with print disabilities in wealthy, advanced economies, and less than 1% in the majority of countries? While anti-discrimination and equality laws operate to enable access, these laws have limited impact on the overriding impact of market forces and copyright laws that focus on restricting access to information. For decades the print disabled have been denied reading equality and have instead had their access to information limited by legal frameworks and resource allocations that tolerated minor exceptions to the mainstream consumption of books and information. The recent United Nations Convention on the Rights of Persons with Disabilities (‘CRPD’), and other international developments, have swept in a new disability politics which is altering what is expected from laws and institutions. The human rights paradigm has created the possibility of achieving equality. The challenge is to analyse barriers to this dream of reading equality and craft laws and institutions that open the E-Book for the world’s print disabled. The lawyer, 56-year-old Eric C. Conn of Pikeville, pleaded guilty on Friday, report the Associated Press, the Lexington Herald-Leader and the Wall Street Journal Law Blog. A press release from the Department of Justice is here. Conn acknowledged that he submitted false documents in more than 1,700 cases, and that he paid the judge about $10,000 per month for about six years beginning in late 2004. Conn admitted that he received more than $5.7 million in fees for representing claimants in the cases, an amount that he promised to repay to the government. He also agreed to pay $46.5 million in restitution to the Social Security Administration, the actual amount of money paid so far as a result of the fraud. Conn will sell his home, his office complex and a 19-foot-tall statue of Abraham Lincoln outside his office to help repay the government. A GoFundMe campaign has been started to save the Lincoln statue, the Houston Chronicle reports. Charges are pending against the administrative law judge and a psychologist accused of falsifying mental impairment evaluations. The Social Security Administration decided to have redetermination hearings for about 1,500 of Conn's former clients and has allowed about 700 to keep their benefits, lawyer Ned Pillersdorf told the Herald-Leader. Pillersdorf has sued Conn on behalf of former clients in a class action suit. Sentencing in Conn's case is set for July 14. He could receive up to 12 years in prison.
