As part of the One Maryland, One Book reading campaign, the Maryland State Library for the Blind and Physically Handicapped has invited Michele Nethercott to speak about the role science plays in helping those who have been wrongfully convicted overturn their verdicts. Ms. Nethercott is the Director of the Innocence Project Clinic and has spent her career working to help those wrongfully convicted. She received her B.A. in Economics from Sarah Lawrence College in 1980 and her J.D. from Northeastern University School of Law in 1984. She has worked as a trial attorney in the Maryland State Office of the Public Defender since 1988. In the 1990s, Ms. Nethercott took additional courses at Johns Hopkins University in molecular biology and genetics to acquire in-depth knowledge of what was then a new type of evidence being introduced to the legal system, evidence obtained by DNA testing. She is now a nationally recognized legal expert in DNA evidence and other forms of scientific evidence, having served as co-chair of the Forensic Evidence Committee for the National Association of Criminal Defense Lawyers. National Organization on Disability August 14, 2018 By: Carol Patton Employers are getting slammed with more Americans with Disabilities Act lawsuits this year, mainly due to a rise in suits regarding non-ADA-compliant business websites. Seyfarth Shaw recently completed its mid-year analysis of ADA Title III lawsuits, projecting that if they're filed at the current pace, they will exceed those filed in 2017 by a whopping 30 percent. Plaintiffs filed 4,965 federal ADA Title III lawsuits during the first six months of 2018 compared to 7,663 for all of 2017. So far, California has the most lawsuits (2,155) followed by New York (1,026) and Florida (882). Of those, 1,053 involved non-ADA-compliant business websites compared to just 814 throughout last year. Among the reasons behind the escalation is that several court decisions in New York ruled in favor of the plaintiffs, that inaccessible websites violate the ADA, explains Kristina Launey, a partner at Seyfarth Shaw. "That emboldened attorneys in New York to say we have a far better chance of winning," she says. "More attorneys and plaintiffs started seeing the vast number [of lawsuits] filed and thought it was a business model they wanted to pursue." Title III of the ADA is regulated by the U.S. Department of Justice. Back in 2010, Launey says, the federal agency planned on developing compliance guidelines for private employers but never followed through. (The DOJ declined to comment for this story.) Meanwhile, she says, the Trump administration has pushed the pause button on this regulatory effort, which created a "Wild West" environment that prompted an avalanche of lawsuits. "But these lawsuits are pushing the concept that you're not providing equal employment opportunity if your website is not accessible," she says, explaining that unlike the past, applying for jobs happens online versus in an HR office. "That's one big thing that many HR execs are being forced to pay attention to." According to a survey of nearly 200 employers conducted by the National Organization on Disability in May, 81 percent of respondents have a plan for improving disability inclusion practices, such as making recruiting, onboarding and training processes accessible to people with disabilities. "When you look at it from a compliance perspective, you limit your ability to develop the value proposition around why being compliant is important," says Felicia Nurmsen, managing director of employers services at NOD. "It's really an important signal to both prospective employees and your own workers-that the company is welcoming people with disabilities." While federal contractors and government agencies are legally required to make digital applications accessible to individuals with disabilities, she says, private employers with 15 or more employees are only "obligated" to do so under ADA. Still, she asks, why would HR ignore a potential labor market that also represents $3.9 trillion in disposable income? Companies are taking action but still have a long way to go, she says. "Disability inclusion is at an early stage in its evolution," says Nurmsen. "Companies that build accessible websites to help court talent with disabilities will improve the overall employee experience." The rising numbers of Title III lawsuits doesn't really surprise David Raizman, co-chair of the national disability access practice group at Ogletree, Deakins, Nash, Smoak & Stewart law firm. He points to the first web-accessibility business case against Target Corp. The National Federation of the Blind notified the retailer in 2005 that its website was not accessible to blind or visually-impaired consumers. Since Target wouldn't commit to taking any action, according to the Web Accessibility Initiative, the NFB sued the company the following year, alleging that it was discriminating against people with disabilities in "places of public accommodation". In 2008, the class-action suit was settled. Seven years later, he says, the DOJ filed a pair of briefs in federal court in Boston saying that despite the lack of federal website regulations, employers were still obligated to make their website accessible to the disabled. "The Justice Department's opinion was quite valuable and tipped the scales quite significantly in favor of those saying the website needs to be accessible now," says Raizman. "Lawsuits are not saying websites are completely inaccessible, they're saying that certain portions of websites are inaccessible." Meanwhile, employers can take their cue from Web Content Accessibility Guidelines developed by the Worldwide Web Consortium in the late 1990s. While some criteria may be considered vague, Raizman says it's still important for companies to observe them. At the very least, he says offer alternatives, such as a job application or employee benefits hotline, and make your website compatible with screen reading software used by visually impaired people. Either way, he says HR needs to work with IT, marketing, and others involved in the company's website, to find out what's been done or going to be done-especially in HR areas like careers, benefits and employment opportunities. Then create a long-term compliance plan. Likewise, employers can also receive assistance from The Partnership on Employment and Accessible Technology, which is funded by the Department of Labor. By just starting the process, Raizman says, "you at least can go into a court of law and say, 'Your honor, we're on our way toward compliance.' "Get the different parts of the business that control the website to build this into their future plans even if they're not going to stop everything and fix it today," he says. "Don't give up." I don't know if anybody is real good at sharing documents and screens, but other functions work fine for me. There is a learning curve and there are some shortcuts that can make certain things easier depending upon what else your business uses. There a lot of keyboard shortcuts, but frankly, I tend to tab to most of what I need. Doug Lee does have scripts and they might be helpful, but I would start by learning without scripts and then see which areas are problematic for you. I am assuming that you are asking because your employer or school already uses it which means you don't have a choice of platforms. Skype for Business certainly works well enough that it won't prevent you from performing job functions. Microsoft has some lists of keyboard shortcuts, but it is important to know which version of Skype for Business you are using. Would be interested in hearing what people find on this. I looked at a review of one book scanning service, and I was just reluctant about the fact that they destroy the printed book and throw it away, and all you are left with is a PDF, but if all you were after was the information I could totally see why it would be useful, and the review was very positive about the results of the PDF. As a result, Hulu will undertake efforts to make its website and software applications accessible via screen readers and will provide audio description tracks for streaming content where possible. With these efforts, Hulu will join the list of online streaming providers, like Netflix, that are prioritizing accessibility features and making the entertainment industry more accessible to the disability community. Hulu offers online streaming services to over 20 million subscribers across the nation. However, none of Hulu's streaming content currently includes audio description-a separate audio track that narrates the key visual elements of video content between portions of dialogue to provide blind and low vision users a full media experience. Under the settlement agreement, Hulu will begin obtaining these tracks for as much streaming content as possible and will adapt its video player so that users can enable and disable this feature, similar to the closed caption option that currently exists on Hulu's video player. Blind community members are enthusiastic about the new opportunity to fully enjoy Hulu's extensive programming selection. According to ACB President Kim Charlson, "These improvements by Hulu will provide people who are blind or have low vision with access to the same online video entertainment services currently enjoyed by millions of Americans. ACB commends Hulu for working with us to enhance access to its services for people who are blind. Our goal is to open up Hulu's services to the blind community and to increase the availability of audio described movies and television programming. Movies and television are a central pillar of American culture. As television and movie content are increasingly delivered through streaming services, this agreement ensures that the blind community will receive and be able to independently use accessible Hulu content. This access is critical to making certain that people who are blind are included as equal participants in today's society." In addition to providing audio description, Hulu will update its website and multiple software applications to ensure that screen-reader users can navigate and interact with the platform. A screen reader is software that enables blind individuals to access and interact with online services by converting the text displayed visually on the screen into audible speech or by outputting that information on a digital braille display. For a screen reader to work, website and app developers must program for compatibility. A single unlabeled button, like those for entering a password or submitting payment information, can render a website wholly unusable. By January 2020, Hulu will ensure that its website and applications are compliant with standard web-accessibility guidelines and that updates are tested for usability. "So many times it is that last step-an inaccessible website-that keeps those who are blind or experiencing low vision from fully enjoying what others take for granted," says BSCB President Brian Charlson, "and now Hulu will be working with us to make sure that their service can be accessed by everyone." Disability Rights Advocates (DRA), a non-profit disability rights legal center, and Disability Law Center, Inc. (DLC), the Massachusetts Protection and Advocacy agency, represented ACB, BSCB, Kim Charlson, and Brian Charlson in these negotiations with Hulu. Rebecca Williford, Senior Staff Attorney at DRA, said, "This settlement will significantly improve access to movies and television for the blind community, moving people with disabilities one step closer to full inclusion in society, which was the promise of the Americans with Disabilities Act." I took Kaplan and, though they provided the materials in an accessible format, the native format was marginally accessible at best. I was also underwhelmed by some major gaps in coverage of material tested on previous exams. I suppose I will know just how serious those gaps were in a week and a half. Derocher Legally blind since the age of 12, Chicago attorney Patti Gregory-Chang has encountered her fair share of ignorance and patronization regarding her disability. The one place where she didn't expect that experience? A bar association meeting. "I came in to register, and the woman at the desk said, 'Oh, honey, this is the bar association. Where are you trying to go?' says Gregory-Chang, a lawyer for three decades. "I'm sure she meant well, but the message she sent was not good, it was not welcoming." As a member of the Disability Law Committee of the Illinois State Bar Association, Gregory-Chang has long advocated for lawyers with disabilities, educating fellow bar members-and staff-on how to better meet their needs, as well of those of the public. One part of that role, she says, is to serve as a bit of a bar gadfly. "The bar is improving, but I've been pestering them for a while," she adds. While sometimes frank and even uncomfortable, that direct dialogue is critical to creating more accessible associations, according to disability rights advocates and bar leaders. Although such discussions-both inside and outside the bar-can help address short-term accessibility challenges, they say, it also has long-term implications. Increasingly longer life spans and later retirement ages may make it more likely that bar associations will see more members facing disabilities, with hearing and vision loss and decreased mobility and cognitive abilities being the most prevalent. Knowing where accessibility challenges lie and addressing them immediately, many experts say, will make bars of any size more available and welcoming to all members-both now and in the years ahead. Making the bar accessible for all At the heart of accessibility for bar associations and any organization is the anti-discriminatory Americans with Disabilities Act. The 1990 civil rights law imposes legal requirements for such associations to provide accessibility for people with disabilities to a wide range of activities, from meeting places to learning and licensing events such as continuing legal education. "There are more and more people with disabilities entering the profession. They want full access to the bar and certain events-and they should get it," says Robert Gonzales, chair of the ABA Commission on Disability Rights. Gonzales is also a past president of the Bar Association of Baltimore City, the Maryland State Bar Association, and the National Conference of Bar Presidents. Accessibility is a key component not only of planning for Commission events and activities, according to Gonzales, but for all ABA events. "If it's not accessible for one, it's not accessible for all," he says. The place where planning for many ABA events and activities begins, Gonzales notes, is the Commission's planning toolkit. Accessibility, he adds, extends far beyond a ramp for wheelchair-bound lawyers. Sign language and captioning for the hearing impaired, Braille and speech-synthesizing screen readers for the visually impaired, and materials and assistance for people with speech and cognitive disabilities are just some of the accessibility accommodations increasingly made for bar members. "I think being fully ADA compliant involves lesser known disabilities such as cognitive disabilities," agrees Doug Knapp, director of electronic communications for the ISBA. "We have focused on making our website, and our vendors' websites, accessible to screen readers, as well as being able to navigate by keyboard, because we know of members who need these functions." A key player in Knapp's efforts: Gregory-Chang, also a former attorney for the city of Chicago and director of outreach for National Federation of the Blind, where she previously served on the executive board. Gregory-Chang has served as a sounding board and tester for the bar's website efforts. "She has given me a huge appreciation for how difficult it is. It really requires a different kind of skill set. You gain an appreciation of what blind people have to go through," Knapp says. "The testing on [screen readers] can be brutal." Barriers often hide in plain sight While Gregory-Chang has appreciated the opportunity to help Knapp, she says bar associations can-and should-do more to improve accessibility. Offering a DVD in place of a CLE event, for example, is not the same, she says. "If you really want to welcome people with disabilities, you actually need to listen to them. Welcome disabled attorneys to talk to your staff. Maybe elevate some of these disability and diversity committees to practice groups or section councils," Gregory-Chang advises. "Diversity is more than race and gender." Leaders of the Monroe County (N.Y.) Bar Association were listening when members complained about accessibility shortcomings two years ago, says Kevin Ryan, the bar's executive director. What followed was a comprehensive anti-discrimination policy that soon led to a problem quite close to home, as bar leaders realized that they weren't in conformance with that policy: A set of men's and women's restrooms in the bar's offices were not accessible. The bar's board approved a $20,000 outlay to create two unisex restrooms, with one of those fully accessible. "Now, we're following our own policy," Ryan notes. The new policy has also been helpful in addressing issues that the bar thought it had addressed previously, according to Ryan. For example, a table that could accommodate wheelchairs had been set aside in a meeting room. The bar consulted with a local disability rights organization and discovered that it was unintentionally segregating members using wheelchairs. The bar also obtained chairs on wheels that allow greater flexibility in seating people with disabilities. The consultant from the disability rights organization continues to assist the bar, Ryan adds. "She's been able to get us resources, and she helped us develop a checklist [for bar-sponsored events]. It's been helpful to reach out to someone in the community who is aware of how these things should be done. She's been a big help." The checklist led to a shakeup in bar events, with some traditional bar event venues being dropped because of lack of accessibility. And a planned change in the bar's main reception area will lead to a new desk that is an appropriate height for people with disabilities. "We now see things that we didn't once see," Ryan says. 'An increasingly hot topic' One thing bar associations are likely to continue seeing is an increase in aging bar members with disabilities, says Pamela Hoopes, legal director of the Disability Law Center at Mid-Minnesota Legal Aid, which is a state-designated protection agency for the ADA. In December 2017, Hoopes facilitated a webinar for the National Association of Bar Executives, focused on disability and accessibility. "Lawyers tend to retire later than a lot of other professionals, and there are challenges that come with that," she explains. "It will be an increasingly hot topic." One task that Hoopes recommends for bar associations to start in their quest to be ADA compliant-or even better than compliant-is to carry out a self-audit. Each state has an agency similar to the MMLA that can provide resources to assist in a self-audit and subsequent compliance efforts. "We try to encourage proactive steps," Hoopes says. "It's not just about compliance. It's really about protecting civil rights." She also encourages bars to either establish disability rights committees or to emphasize the need to address such issues through access-to-justice or diversity committees, as well as working with the state and local judiciary to carry out joint efforts to improve accessibility in the courts. On the national level, Gonzales says the ABA is increasing efforts to foster technological advancements that will lead to improved accessibility for lawyers and everyone accessing the legal profession. Part of that effort, he adds, is encouraging some of the nation's top law firms to develop comprehensive accessibility plans. While much still needs to be done, Gregory-Chang says, the increasing efforts by law firms, bar associations, and the courts to improve accessibility are being noticed by people with disabilities-particularly those who have worked to hide their disabilities over the years, such as the hard of hearing and people with epilepsy and mental health issues. "You really have to train your staff, and work to make [bar associations] welcoming, inclusive environments," she says. "We want equal access. We want to participate fully." If you have access to the Los Angeles Daily Journal, checkout: "Who is telling the truth?" by MYRON MOSKOVITZ (10/2/2018). His focus is on fact finding by jury or judge and the implications for appellate review. Here is the gist: "Although most people cannot do better than chance in detecting falsehoods, most people confidently believe they can do so." Wellborn, "Demeanor," 76 Cornell L.Rev. 1075, 1081 (1991). Psychologists who have conducted experiments on these issues generally conclude the following: * Watching a witness' body movements is rarely useful -- and is often misleading. * Listening to the witness' voice is sometimes useful, and less often misleading, but is generally not helpful. * Cross-examination at trial -- the adversary system's famous "engine of truth" -- can cause changes in demeanor that lead the fact-finder away from the truth. * Most useful of all is carefully examining the content of the witness' testimony -- and paying no attention at all to her demeanor. In fact, demeanor often leads you away from the truth. One study indicates that juries focus on demeanor most when witnesses disagree, so a focus on demeanor can determine the outcome of a case that turns a credibility battle. One study showed that California judges did no better than chance at detecting liars from demeanor. (Same with cops and psychiatrists. Only group to do better than chance were Secret Service agents.) First, many common tells of lying are readily detectable to a blind person: throat clearing; vocal tension; shallower breathing; fidgiting or feet shuffling; over verbosity; unnatural hesitations inconsistent with the rest of their answers. I could go on and on. The notion that because we can't see one or two visual cues we can't spot a falsehood is ridiculous. Moreover, in investigative work, experienced investigators will tell you they often follow their gut. Of course blind people have gut instincts as well. But at the end of the day, as lawyers, what our gut says doesn't matter, it's what the testimony and the facts reveal. That's the record we work with. I've seen seasoned lawyers go down rabbit holes in depositions that leave me scratching my head, knowing they just waisted their time and didn't get what they were after. It happens, and it has nothing to do with whether or not they can see. Best, Chris
