The Department of Justice plans to file its first report in a decade on the accessibility of federal government websites, following a bipartisan push in Congress. "The Department of Justice ... recognizes the critical importance of accessible technology to millions of Americans with disabilities," the DOJ said in a letter received Monday by Sen. Bob Casey (D-Pa.), who had written to the department in June to demand that the government report on its compliance with accessibility standards. The DOJ added that it intends to submit the document "in the coming weeks." Under Section 508 of the Rehabilitation Act of 1973, federal agencies are required to make their electronic and information technology accessible to people with disabilities. The DOJ must also collect and report information to the president and Congress about federal agencies' compliance with Section 508 every two years, and it must make the report publicly available. "It's something that should have been done every other year, and now we're more than 10 years down the road," Glenda Sims, the chief information accessibility officer at digital accessibility company Deque Systems, told HuffPost. "But we have to do that. It's monitoring the health of our important government websites that people need to use and have independent access to." The most recent report filed by the DOJ in 2012 showed "mixed levels of success" in federal website accessibility. In his letter this summer, Casey and six other senators requested that the department resume its reports and explain why it hadn't filed one for so long. "On behalf of the 26 percent of Americans living with a disability, including the 40 percent of people over age 65 who have a disability, we write to urge DOJ to take immediate steps to meet its obligations and once again issue these biennial reports," the senators wrote in June. "Without regular reports, Congress, taxpayers, and agencies themselves lack a crucial source of feedback for identifying and resolving longstanding accessibility issues." The DOJ's recent letter, which Casey's office shared with HuffPost, did not provide an explanation for its decadelong lack of compliance. The department did not immediately respond to HuffPost's request for comment on its renewed commitment to reporting. "Despite legal requirements, these reports had not been issued for a decade, leaving Congress without critical information about how the federal government is addressing accessibility of its technology," Casey told HuffPost. "We have a long way to go to make all aspects of the federal government accessible for people with disabilities, but getting this information from [the] DOJ is a critical step." The U.S. Access Board is responsible for developing federal accessibility standards, which include requirements for ensuring capability for assistive technology. According to 2019 statistics from the Census Bureau, nearly 11.5 million Americans have hearing disabilities and 7.5 million have visual disabilities. Website accessibility is important for such people because it provides equal access to information, said Sims. But in a 2021 report, the nonprofit Information Technology and Innovation Foundation found that many pages on popular federal websites failed an automated accessibility test. The report showed that 30% of homepages did not pass the test, and 48% failed on at least one of their three most popular pages. Sims believes that developers aren't intentionally building access barriers, but rather that the barriers are easy to miss. She hopes that in the future, developers will be motivated to incorporate accessibility correctly into their website designs. She emphasized that the design and development community needs automatic accessibility checkers in place. "I think that making it a requirement to put in these automated testing tools will help raise awareness," Sims said. She added that analyzing accessibility design in this way would "make it easy for developers and designers and content contributors to run checks so that we don't always have to be dragging an accessibility expert in to figure out whether it works or not." In the Indian legal system, e-files are structured this way. We have one large consolidated pdf that subsumes within it pleadings, evidence, relevant orders and other things. I typically use Bookworm for reading PDFs. It does not work with such PDFs. Nor do Edge or CHrome. Only Adobe does. And then, too, it does not enable me to access the tree view clearly. Nor the actual content of any document, even after pressing f6. ANy thoughts? I am getting a para legal to break these down into a zip folder with individual PDF files. Since I end up wanting to view and access constituent documents separately, I end up individually isolating bundled materials. You see something like this for e-filings in the U.S., but nothing is embedded or merged. I like having the ability to review a memorandum of law and a supporting exhibit independently of the other. It seems like the zip file of PDFs should be a good solution. Is there a reason it is not working well for you? What concern do you have about it? I typically use Bookworm for reading PDFs. It does not work with such PDFs. Nor do Edge or CHrome. Only Adobe does. And then, too, it does not enable me to access the tree view clearly. Nor the actual content of any document, even after pressing f6. ANy thoughts? I am getting a para legal to break these down into a zip folder with individual PDF files. This conclusion is based on a slightly different situation from yours, but I hope it is helpful. A few years ago, I was working on an SEC matter, and the Commission permitted us to come to headquarters to review papers that are usually printed out. SEC counsel knew that I was blind because I had come to take notes for a partner during in-person settlement discussions. When I asked SEC counsel if I could bring a paralegal with me to assist in reviewing the papers or else to have the paralegal read them to me over the phone, he was fine with it. It turned out that I did not have to review anything afterall, but I was prepared with a solution that worked for me, the client, and the Commission. The following is not legal advice, and you should look into privilege and privacy law more and/or consult with your own internal GC: An attorney's support staff, including paralegals are deputies of the attorney. Their participation in a matter does not destroy privilege. Privilege is also usually more protected than privacy. That means that if conditions are such to preserve privilege, they are usually just as adequate to preserve privacy. Of course, it gets more nuanced, but if you are not speaking with an attorney, you may get a reflexive no to an accommodation. The email from your paralegal was a good way to handle it. It is also not a bad idea to have as much of the material content immediately accessible to you. I know that is not always possible. However, when you have control over the schedule, you should be able to prepare both yourself and your materials. The answer changes a bit if you are a law student/judicial clerk versus a working attorney. When I was still in law school, I used the NALP directory to get contact information for law firms. I did not apply through NALP, because the website did not (and probably still does not) have any kind of application processing function. I believe OSCAR is used for locating a federal clerkship post, but I have never used it to apply for anything. However, I did use it to download applications when I was clerking and sifting applications for the judge, and though a bit tedious, it was okay. The few times I used Indeed, it worked well. I also found LinkedIn okay, too. You can also go directly to the "careers" or "jobs" page of a company, public interest firm, or certain government agencies to review any openings and apply. I think someone else mentioned US Jobs for federal government posts. That is pretty good and reasonably accessible. I will add that sometimes you can find other openings on the agency website where the application process is even more straight forward, i.e. sending an email with supporting attachments. Finally, do not forget about good old fashioned cold applications to the office of attorney/legal recruitment. It is still possible to get a job this way. We will honor Scott at our NABL Annual Meeting in July as well. Obituary: Scott Charles LaBarre Centennial, Colorado July 2, 1968 - December 10, 2022 Scott Charles LaBarre, age 54, passed away surrounded by his family on Saturday, December 10, 2022 after a short but courageous battle with cancer. Scott was born July 2, 1968 in St. Paul, Minnesota. He Graduated from St. John’s College in Collegeville, Minnesota and went on to graduate with his Juris Doctorate degree from the University of Minnesota. Scott lost his sight at age 10 but lived his life by the moto that he could do anything. He clerked in Washington DC in the office of US. Representative Gerry Sikorski. He was awarded a Scholastic Achievement award and met President Bush. He moved to Denver where he met his wife and became very involved in the National Federation of the Blind. He was a fierce leader in the movement for disability rights and spent decades working for the blind of his generation and beyond. He argued in the courts on behalf of blind people who experienced discrimination, served as president of the Colorado affiliate and most recently served as national general counsel, and personally mentored hundreds of individuals—all while raising a family. Scott was a lawyer who ran his own private law practice in the areas of employment law, disability rights, and international copyright policy. He held several leadership positions within the American Bar Association and the organized blind movement. He served as chairman of the Colorado Center for the Blind, led the National Association of Blind Lawyers, and helped establish and guide the Jacobus tenBroek Law Symposium. His impact will continue to ripple across the world because of his leadership in securing the Marrakesh Treaty, an international agreement permitting the sharing of accessible books, which was just one among the many ways he created positive and lasting change. Between many long hours of work and travel, he raised 2 beautiful children, and watched as much of his beloved Colorado Avalanche and Minnesota Vikings as possible. He was an avid music lover and enjoyed sharing his favorites with others, and adored playing with his beloved labradoodle, Moka. Scott is survived by his wife, Anahit, and their children, Alexander and Karter. He is also survived by his brother, Craig (Debrah), his parents Donna and Charles, and his dog, Moka. Per the request of his family, memorial contributions should be directed to either the Colorado Center for the Blind or the National Federation of the Blind for the work to empower blind people to live the lives they want, to which Scott gave so much. As a result, those who purchased or obtained access to a non-subscription license of Office 2016 or later do not have access to these enhancements. That may or may not, however, be the cause of the specific issue you are experiencing, but it may be worthwhile investigating further. Hope this helps.
