The laws vary from state to state.  Here, a child must be either four years 
old or forty pounds.  I switched my daughter when she was about four and a 
half, and the top of her head got to where it was within an inch or so of 
the top of the seat back, because that was when the seat would no longer 
protect her more than a booster would.  It was a relief to switch to a 
lighter, more portable and easy to install booster.
