I believe the NLS argument would go like this...

First, the "lost" stream has keys that be tracked to a user, who is
responsible for notifying the library if a stream is lost.

Second, the win of an iphone being able to phone home is more than
drowned out by the ability for someone to jailbreak the phone and
rescue the keys from the phone.  Now, the cost of one user not
reporting a lost phone is much higher, because now the keys can be
duplicated and handed out.

Having said this, NLS' security around this is not even close to air
tight. However, they *have* come up with a security framework, and
they are building their program around that framework.

Finally, even if someone were to find a more vulnerable hole in their
framework, NLS would almost certainly continue to use the framework
anyway.  It's done. Recorders are built, content is being deployed,
the ship is out.

This really sucks for blind people in other parts of the world, and I
hope that NLS can figure out a way to make US content available to
them.
