> **2 Cullen & Associates Session Update
> Just two days after the Illinois Comptroller announced she would release $800 million in past-due Medicaid payments to managed care organizations and $150 million to hospitals, a group of doctors, health care providers, and Medicaid managed care companies (including Aetna and Meridian) filed affidavits in federal court stating that they may stop providing care to hundreds of thousands of Medicaid patients in Illinois if state government continues to delay its court-ordered Medicaid reimbursement payments. As one may recall, a judge ordered the State to continue to pay for Medicaid services despite the lack of appropriation to do so.  While the Department of Healthcare and Family Services (HFS) continues to process payments to the Comptroller’s Office, payments cannot be made in a more timely manner due to lack of cash-flow.  Despite the recent $950 million payment, Medicaid past-due bills stand at $2.7 billion. Providers are threatening to leave Medicaid MCO networks due to lack of payment.  Doctors serving Medicaid patients on a fee-for-service basis are paid in 30 days.  A court hearing on the matter is scheduled for May 9th.

> On Tuesday, Illinois Comptroller Susana Mendoza sent a letter to Governor Rauner expressing her concerns over HFS’ February 27th RFP to restructure the State’s capitated Medicaid managed care service delivery system.  Mendoza specifically asked Governor Rauner to consider extending the RFP’s deadline to provide more time for discussions on the matter.  A full copy of Mendoza’s letter to the Governor is here.  Senator Sandoval filed SR480, which urges the Department of Health and Family Services to immediately suspend the Medicaid managed care RFP and urges the General Assembly to convene the Special Committee on Oversight of Medicaid Managed Care to review the RFP.  The Illinois House Human Services and Appropriations Human Services Committees are holding a joint hearing on Wednesday at 2:30 pm in Room 118 of the Capital to discuss the Medicaid MCO RFP.

> Senator Hasting’s “expatriate companies” restriction bill failed in the Senate earlier today, and SB 1798 has been placed on the Order of Postponed Consideration and could be called for a vote one more time. 
>  
> Senator Biss’ “privilege tax” legislation, SB 1719 (SCA 1), passed out of the Senate Revenue Committee by a vote of 5 – 4.   The bill, as amended by committee amendment # 1, provides that the privilege tax shall be imposed beginning on July 1, 2017 at the rate of 20% of the fees earned from the investment strategy of the investment manager and not from the investment itself.  The amendment also removes the bill's immediate effective date, and the bill's effective date is contingent upon the states of Connecticut, New Jersey, and New York enacting laws having an effect identical to the bill.  Companion legislation (HB 3393 (Welch)) did not meet the 3rd Reading deadline and has been referred to the House Rules Committee.
>  
> Senator Connelly filed an amendment to SB 1039, which makes it unlawful for an employer by contract or waiver to prohibit an employee from disclosing or discussing the employee’s wage, salary or compensation benefits.  The bill further makes it unlawful for an employer to seek the wage or salary history or prior compensation benefits of a prospective employee or require that a prospective employee’s prior wage or salary history meet certain criteria.  The amendment has been referred to Senate Assignments.
>  
> Legislation to provide public funding for state level political campaigns, SB1424 (Biss), failed in the Illinois Senate by a vote of 29-23.  The bill was placed on postponed consideration and could be considered again later in the session.
>  
> The Senate narrowly approved The Right to Know Act, (SB1502 (Hastings), which provides that an operator of a commercial website or online service that collects personally identifiable information via the internet about individual customers residing in Illinois who use or visit its commercial website or online service must provide notice to customers regarding personal information sharing practices. SB 1502 now moves to the House for consideration. Companion legislation, HB2774 (Turner), has been re-referred to the House Rules Committee.  
>  
> Senator Manar filed a new education funding reform amendment, SB 1 (SFA 4).  The legislation, which is part of the larger grand bargain plan in the Senate, remains on the Order of Third Reading.   The Senate Education Committee heard subject matter testimony Thursday evening on competing education funding reform plans filed by Democratic Senator Andy Manar and Republican Senator Jason Barickman (SB 1124 and SB 1125).
>  
> Immigration legislation, referred to as the Illinois Trust Act (SB 31 (President Cullerton)), narrowly passed the Illinois Senate by a vote of 31-21-1.  The bill provides new requirements and restrictions for state and local law enforcement officers in Illinois and would stop law enforcement officers from enforcing federal immigration detention requests or cooperating with federal immigration agents who have not obtained a criminal warrant. The bill would also create “safe zones” at schools, medical facilities, facilities operated by the Secretary of State, and courts.  Senator Cullerton pledged to continue working with the law enforcement community as the bill progresses.
>  
> A controversial bill in the Senate that would create the Home Birth Safety Act for the licensure of midwives by IDFPR has an extended deadline through May 31st.  SB 1754, on the Order of Third Reading and sponsored by Majority Caucus Whip and Chair of the Licensed Activities and Pensions Committee Iris Martinez, is an initiative of the Coalition for Illinois Midwifery.  The bill has a bevy of opponents, including most provider groups, most notably the llinois Health and Hospital Association and the Illinois State Medical Society, in addition to the Illinois Department of Financial and Professional Regulation.  HB 677 (Gabel), an identical bill in the House, has been re-referred to the House Rules Committee.
>  
> An amendment was filed to HB 3462 (Zalewski/Martinez) removing provisions concerning automated pharmacy systems and remote dispensing, and the bill is posted for Senate Licensed Activities next week.  The Pharmacy Practice Act sunset will be delayed and the Collaborative Pharmaceutical Task Force will meet in the interim to recommend language to the General Assembly that will address:  (1) pharmacy workplace and whistleblower rules (raised by unions in Chicago and Representative Flowers earlier this session); and (2) pharmacy prescription, storage, and dispensing systems and tracking to stop pharmacy shopping and dangerous  drug interactions (as related to a pharmacy “sting” as conducted by the Chicago Tribune.)

> The Illinois State Medical Society’s legislation to create the Network Adequacy Transparency Act (HB 311 (Greg Harris)) has been assigned to the Senate Insurance Committee and is posted for next week.

> Only the Senate was in session this past week. Both chambers return Tuesday, May 9th. The focus continues on committee action for bills that have advanced to the opposite chamber. The Senate deadline to report substantive House bills from committee is Friday, May 12th and the House deadline to report substantive Senate bills from committee is May 19th.

> There was no further movement in the Senate on their “grand bargain” compromise package. Also, the Senate has not taken any action on HB 109 (Representative Gregory Harris and Senate President Cullerton), the stopgap spending bill that provides $800 million in partial funding to some human service programs and higher education for FY17. The bill is still on Third Reading in the Senate.

> Governor Rauner continues to push for the sale of the James R. Thompson Center in Chicago, saying that the estimated $220 million in revenue from the sale could help the state’s coffers, as well as add up to $45 million a year in property taxes in Chicago. On Tuesday, Mayor Emanuel said he is concerned with the cost of rebuilding the CTA station located underneath the Thompson Center and said the developer or the state should pay the costs to rebuild the station. On Friday Rauner announced that Senate Minority Leader Christine Radogno and House Minority Leader Jim Durkin filed legislation (SB 2209 and HB 444) that will direct all future property tax receipts from the redevelopment of the Thompson Center to Chicago Public Schools.

> A group of activists is planning a 15-day, 200-mile march to Springfield to demand an end to the ongoing state budget crisis. Fair Economy Illinois — which includes immigrants, veterans, representatives from minority communities, students and religious organizations — backs what it calls the “People and Planet First Budget,” which includes an estimated $23.5 billion the group believes could be raised by closing corporate tax loopholes, passing a financial transaction tax on LaSalle Street trades and requiring wealthier Illinois residents to pay a higher percentage in state income tax. The march will start at noon on May 15 with a kick-off rally at the Thompson Center. On the way to the Capitol, marchers plan to hold events in Chicago, Joliet, Dwight, Bloomington and Springfield, where they hope to find stories about how people have been affected by the state budget impasse.

> On Friday the Senate overwhelming passed a new automatic voter registration plan. SB 1933 (Senator Manar) would automatically register qualified voters when they visit Secretary of State’s offices and a handful of other state agencies unless they decide to opt out. It moves to the House after a 48-0 vote in the Senate. A previous version passed both chambers last fall but Governor Rauner vetoed it over concerns it didn’t do enough to prevent voter fraud. Manar says this version addresses nearly all of Rauner’s concerns.

> Governor Rauner released the following statement regarding the U.S. House of Representatives’ passage of the American Healthcare Act: “The bill that passed in the U.S. House today continues to be of deep concern to our administration. Recent changes did not address fundamental concerns about the bill’s impact on the 650,000 individuals that are part of our Medicaid expansion population, nor have those changes eased the concerns of the 350,000 people in the individual market who are dealing with skyrocketing premiums and fewer choices. We will continue to voice our concerns as the law moves to the Senate. The Affordable Care Act is a seriously flawed law that should be changed. Difficult as the task has proven, we are hopeful that our federal lawmakers will continue to work hard to get this right for the people of Illinois and our nation.”

> Partial Summary of 4/19/17 Meeting; Equip for Equality (EFE) hosted a meeting to discuss issues impacting persons who are blind and visually impaired on April 19, 2017.  The purpose of the meeting was to solicit input from the blind community to provide guidance for EFE on case acceptance and proactive initiatives.  Numerous representatives of the blind community attended the meeting.
>  
> The following summarizes the issues raised at the meeting. We tend to focus on assistive technology issues for funding reasons, but EFE will also consider any other issues presented which impact persons who are blind and/or visually impaired and which may be addressed within the legal system.
>  
> EFE Policy Update
> There was a brief discussion about some pending legislation:
> HB 2626  Creating the Parental Rights for the Blind Act:  We updated the group that there had been a recent amendment requiring the Department of Children and Family Services (DCFS) to develop and implement procedures to ensure and provide equal access to child welfare services, programs and activities in a nondiscriminatory manner, including proceedings under the Juvenile Court Act and proceedings to terminate parental rights.  It also requires DCFS to provide training to child welfare investigators and caseworkers on these procedures.  Further, if a court determines that a blind person’s rights with respect to allocation of parental responsibilities or time, foster care, guardianship, or adoption should be denied or in any way limited, the court must make a specific written finding stating the basis for such a determination and why supportive parenting services cannot prevent the denial or limitation.

> HB3162   Requires the Department of Financial and Professional Regulation to establish a service dog license program under which a dog action as a service dog shall be licensed.  There are detailed additional requirements which contradict the Americans with Disabilities Act (ADA) and DOJ guidance.
>  
> The bill may have arisen due to a lot of press reports about “fake” service animals.  The bill’s sponsor apparently wants to form a committee to determine how best to address this problem. It is hoped that individuals with service animals will participate on this committee.  Another comment indicated that the State of Florida may have a good model for a service animal law.
>  
> SB 1995  Amends the Illinois Insurance Code to provide that a group or individual policy of accident and health insurance or managed care plan must provide coverage for the purchase of a service dog that is specially trained to assist blind, deaf, or mobility impaired persons or persons with a disability that is other than physical, provided the insured’s treating health care provider certifies in writing that the service dog is medically necessary.  Requires the service dog to be purchased from a nonprofit organization that is established for the training of such dogs, and is an accredited member of a professional association of guide dog or service dog organizations.

> Some of these bills have pros and cons, and we suggest that you read the entirety of the bills for the full picture.

> EFE Civil Rights Team Updates   
> EFE and a private law firm (RSP identified below) have been negotiating with Carle Foundation Hospital which is headquartered in Urbana, Illinois, regarding access barriers for persons with visual impairments as well as ambulatory and auditory impairments.       EFE provided an update on our structured negotiations.  Carle is working on addressing the concerns we have raised, and we believe that updated policies and staff training will be a large part of the ultimate solution.  EFE has also received some recent complaints about Carle’s accessibility with respect to valet services as well as the treatment of a blind patient as an automatic fall risk, without any individual assessment.  We plan to raise these issues during the course of our negotiations.  We hope to have a written settlement agreement in 2017.

> There was discussion that many rehabilitative centers as well as nursing homes routinely treat blind people as fall risks and consequently impose restrictions on patients without consideration of the individual’s condition and capabilities.  This led to comments that airports often try to force people who are blind to use wheelchairs, even though the individual did not request and does not wish to use a wheelchair.  It was suggested that the airports cannot force such action and that anyone objecting to the wheelchair should refuse it.  Interestingly, there was a comment that while going to a medical procedure, staff at Northwestern Memorial Hospital insisted that a blind man take a wheelchair, however, after the procedure which involved anesthesia, they did not do so. 
>  
> EFE announced that the lawsuit filed by the Chicago law firm of Robbins, Salomon and Patt against OSF Healthcare system based in Peoria was resolved in January 2017.  The suit was filed due to OSF’s failure to accommodate patients with disabilities.  A summary of the result was sent out to this group via email on April 17, 2017, and is copied again below for your information.  EFE has co-counseled other similar cases with this law firm which we have pursued through structured negotiations instead of litigation.
>  
> On January 6, 2017, OSF has announced an initiative to enhance its commitment to ensure equal access to its services for patients with disabilities, including those who are deaf, hard of hearing, blind, have low vision or mobility disabilities.  Among other things, OSF will adopt and implement additional screening procedures to identify persons requiring auxiliary aids and services; ensure the availability of auxiliary aids and services to achieve effective communication throughout the admission of a patient; and make periodic assessments to ensure it has an appropriate number of computers, tablets or other devices to be used for video remote interpreting services.  In addition, OSF will provide additional staff training to ensure persons with mobility disabilities are weighed when clinically appropriate using wheelchair accessible weight scales; reaffirm its commitment to respect the rights of persons with mobility disabilities to choose among a range of transfer and lift options consistent with their clinical needs; and survey its parking facilities to ensure compliance with accessibility standards.
>  
> Persons with disabilities who will utilize OSF’s services and facilities who have questions regarding OSF’s accommodations and services are encouraged to contact OSF’s Section 504 Compliance Officer at (309) 308-5978.
>  
> EFE sent a demand letter to BMO Harris Bank on behalf of a blind woman who was denied Braille statements for her accounts.  She was told that the bank didn’t provide such services, but that maybe they would if more people requested Braille statements.  We hope to negotiate a resolution of this issue with the bank so that she and other blind individuals can obtain statements in formats that are accessible to the individual involved.
>  
> This prompted some discussion of other companies that provide Braille, and the wide range of information included by different companies when Braille statements are provided.  One attendee offered that Discover now provides statements in Braille.  It was said that Com Ed puts statements onto one page, meaning that these statements are abbreviated compared to the written version.  U.S. Bank is said to provide Braille, as well as Chase credit card department.
>  
> EFE provided an update on a lawsuit we had filed on behalf of a blind inmate in state prison.  The prisoner sought an accessible TABE (Test of Adult Basic Education) which is readily available and very inexpensive, but the Illinois Department of Corrections (IDOC) refused to provide it for him.  The U.S. District Court dismissed our complaint citing a failure to exhaust administrative remedies.  We disagree with this conclusion, and also believe that this situation illustrates IDOC’s failure to accommodate prisoners with disabilities within the grievance process.  We appealed the decision to the 7th Circuit Court of Appeals and there is a May date set for mandatory mediation.  If the case is not settled through mediation, we will be briefing the case for the 7th Circuit.

> We mentioned that the producers and theater in New York where Hamilton is playing have been sued due to limited audio described performances.  Now, in Chicago, a Goodman employee who freelances is providing audio description for Hamilton for Broadway in Chicago.  We also mentioned that the American Theater Company on the north side announced their inaugural accessible performances which include captioning and audio description and touch tours.

> EFE talked about an Illinois Information Technology Accessibility Act Standards Update group beginning the following day and run by the state Department of Human Services.  We sent an email out later on the day of the meeting for those who wished to call into that teleconference.  There are numerous state websites that are not fully accessible to screen readers and it is hoped that this committee will eventually take steps to correct those deficiencies.

> It was mentioned that the online process to fill out witness slips for bills pending before the Illinois General Assembly is not accessible to screen readers due to the use of captchas.  EFE looked into this after the meeting and noted that if an individual registers at the ILGA website, then captchas are not a hindrance to the witness slip process.  An EFE employee who uses a screen reader did not actually submit a slip, but he checked through everything on the witness slip page. In short, as far as he could tell, everything seemed accessible. With regard to the captcha, it was there, but there was an option for an audio version, and unlike many recordings that are inaudible, he found this one to be intelligible.  He did not identify any accessibility barriers provided that one does register and login. If anyone registers and logs in, and still has an accessibility issue with regard to submitting a witness slip, please let us know.

> Baltimore, Maryland (May 8, 2017): The National Federation of the Blind today announced the launch of a program to test the effectiveness of ridesharing companies Uber and Lyft's efforts to accommodate passengers with guide dogs and other service animals. The NFB seeks the participation of blind people and other service animal users, or those who travel with them, across the United States and in Puerto Rico. Volunteers will be asked to fill out an online questionnaire to indicate whether or not they were denied service because of their service animals or if they were treated in a discriminatory or disrespectful manner. Both positive and negative experiences should be reported. Pursuant to agreements with the National Federation of the Blind, both Uber and Lyft are taking steps to prevent discrimination against, and improve service to, riders with service animals. The agreements require the National Federation of the Blind to provide feedback to the companies over a three-to-five-year period. The program is open to both members and non-members of the National Federation of the Blind. The online questionnaire is available in both English and Spanish.
