The Executive Order will benefit hundreds of thousands of people working 
under service, construction or concessions contracts with the federal 
government who are making less than $10.10 an hour. It will also improve the 
value that taxpayers are getting from the federal government’s investment. 
Studies show that boosting low wages will reduce turnover and absenteeism, 
while also boosting morale and improving the incentives for workers, leading 
to higher productivity overall. These gains improve the quality and 
efficiency of services provided to the government.

The Executive Order covers individuals with disabilities.  Speaking on the 
importance of raising the minimum wage before signing the Executive Order, 
the President said:

“There’s a simple moral principle at stake -- if you take responsibility and 
you work as hard as these folks work, if you work full-time, you shouldn’t 
be living in poverty. Not in America. We believe that. And this executive 
order will cover Americans with disabilities because this principle doesn’t 
just apply to some of us; it applies to all of us.

Under current law, workers whose productivity is affected because of their 
disabilities may be paid less than the wage paid to others doing the same 
job under certain specialized certificate programs. Under this Executive 
Order, all individuals working under service, construction or concessions 
contracts with the federal government will be covered by the same $10.10 per 
hour minimum wage protections.

President Obama Announces Presidential Delegation to the 2014 Paralympic 
Winter Games


The Opening Ceremony of the 2014 Paralympic Winter Games in Sochi, Russian 
Federation will be held on March 7, 2014.

Members of the Presidential Delegation include The Honorable Kathy Martinez, 
Assistant Secretary for Disability Employment Policy, U.S. Department of 
Labor and The Honorable Tammy Duckworth, Member of the United States House 
of Representatives (IL-08).

The delegation will attend athletic events, meet with U.S. athletes, and 
attend the Opening Ceremony.

On February 4, President Obama visited Buck Lodge Middle School in Adelphi, 
Maryland, to promote his ConnectED Initiative, which aims to enrich K-12 
education in America.

“ConnectED empowers teachers with the best technology and the training to 
make the most of it, and empowers students through individualized learning 
and rich, digital content.”

In a technologically-drive era, fewer than 30% of America’s schools have the 
capacity needed to incorporate technology in the education system. The 
Initiative helps bridge this gap by equipping America’s students with the 
skills and experiences needed to secure jobs and compete with countries in 
the future.

The President also announced that private-sector companies—such as Apple, 
AT&T, and Microsoft—have committed more than $750 million to deliver 
cutting-edge technologies in the future.

On February 5, First Lady Michelle Obama visited T.C. Williams High School 
in Alexandria, Virginia, to meet with students at a FAFSA (Free Application 
for Federal Student Aid) workshop. She also spent time delivering some 
encouraging remarks to the students in pursuit of higher education:

“For those of you who might be wondering why the First Lady is here just to 
watch you fill out a computer form, it’s because completing this form is a 
critical start to completing your education. And as the president and I will 
continue to stress over the next several years and beyond to young people 
throughout this country, completing your education – whether it’s a 2-year 
or 4-year college, or vocational program – is the single most important 
thing you can do for your future. That is it. There’s nothing that compares 
to getting your education.”

“With a good education, you can get a job that pays a decent salary or more. 
You can provide for your family, which is key. And you can become whatever 
you dream of becoming, which is the kind of freedom that I want all of you 
to have. And filling out the FAFSA form is one of the first and most 
important steps you can take in that journey.”

Department of Justice Publishes Notice of Proposed Rulemaking to Implement 
ADA Amendments Act of 2008

The Department of Justice recently published a Notice of Proposed Rulemaking 
intended to revise the department’s Americans with Disabilities Act (ADA) 
Title II and Title III regulations to implement the requirements of the ADA 
Amendments Act of 2008 (ADAAA).  Congress passed the ADAAA in response to 
several Supreme Court decisions that had narrowly interpreted the ADA’s 
definition of disability.  The ADAAA made a number of significant changes to 
the ADA definition of disability to ensure that it would be easier for 
individuals seeking the protection of the ADA to establish that they have a 
disability that falls within the meaning of the statute.

“The narrow interpretation of the ADA’s definition of disability resulted in 
the denial of the law’s protection for many individuals with impairments 
such as cancer, diabetes and epilepsy who had been the subject of adverse 
actions due to their disabilities,” said Acting Assistant Attorney General 
Jocelyn Samuels for the Civil Rights Division.  “The ADAAA and our proposed 
regulations properly place the focus of ADA cases on whether a covered 
entity has complied with its obligations and whether discrimination 
occurred, and not on whether the person has a disability.”

The ADAAA’s revised definition of disability applies to Title I, which deals 
with employment, as well as to Titles II and III of the ADA.  The Equal 
Employment Opportunity Commission, which is responsible for developing 
regulations that implement Title I of the ADA, published its revised Title I 
regulation incorporating the ADAAA in March 2011.  The department has made 
every effort to ensure that its proposed revisions to the Title II and Title 
III regulations are consistent with, if not identical to, the corresponding 
provisions in the Title I regulation.  This will ensure that the definition 
of disability is interpreted consistently for all three titles of the ADA.

On January 22, 2014, after nearly a year of meeting and deliberating with 
stakeholders from across the nation, the nonpartisan Presidential Commission 
on Election Administration (PCEA) released their report

“The recommendations and best practices urged by PCEA are an excellent 
foundation,” said Clyde Terry, Chair of the National Council on Disability’s 
(NCD) Policy Development & Program Evaluation Committee. “But, as always, 
implementation and enforcement are key. We must take concrete steps to 
ensure full participation, the removal of unnecessary barriers, and 
guarantee voting accessibility at every stage of the electoral process, in 
every state and every locality. No one wants to be doing this again in 10 
years.”

As an independent federal agency that recommends disability policy to the 
President, the Administration and Congress, NCD was particularly pleased the 
PCEA echoed the recommendations issued in its own October 2013 report 
“Experience of Voters with Disabilities in the 2012 Election Cycle

* States and localities must adopt comprehensive management practices to 
assure accessible polling places.

The importance of these steps cannot be overstated. As PCEA stated in its 
report, “The share of the voting population with disabilities will also grow 
considerably as the Baby Boomer population ages. Issues of voting and 
accessibility, therefore, are not ones for a discrete subset of the 
population. Rather, they are issues that many, if not most, voters may 
experience at some point in their lives.”
