Hi Bill and all,
In general, I've learned that the best weapon against discriminatory
statements is to ask them to put it in writing. If they say "we won't
accept you because you're blind" ask them to put it in writing and
tell them you won't abide by their policy, whatever it is, unless it's
in writing. This may not work if they're smart about the risk of
litigation and  refuse to give their statement to you in writing, but
if they really believe that what they are doing is justified and OK,
they may not mind putting it in writing. Of course if you have their
language in writing and it spells out clearly discriminatory
reasoning, you can potentially raise a complaint.
Along similar lines, outside the housing domain, if you are being
discriminated against it's important to document in your own written
form what is going on. If teachers or professors aren't giving you
alternative format or other accommodations, keep a journal of when it
happens and what is said and done, from your perspective. If a
professor tells you you can't take their course, even if they won't
put it in writing, keep a written record yourself. Same goes for
overly pushy DSS offices making what you feel are inappropriate or
unsolicited accommodations. If a DSS office insists it's "their
policy" to do things a certain way, ask for the written policy. But if
they won't provide it, again, still write down what they said to you
verbally. This will help inform advocates or other officials helping
you out about what exactly is going on, how often it's happening, etc.
I learned about this long ago when I was in the fourth grade, believe
it or not, and a bus driver told me that I had to sit in the very
front of the bus for alleged safety reasons. He said it was "against
the law" for me to sit anywhere but in the very front row. This may
not sound like a big deal, but in elementary school (at least at my
school) there was an unspoken bus hierarchy. The cool kids sat in the
back and the "losers" or the kindergarten kids sat up front. This
"law" had serious social ramifications for me. Luckily when I brought
the situation to my dad's attention, he decided it worthwhile to
investigate the supposed law further. After months of (pre-Internet)
research, my dad discovered a written policy of my school district and
from what I can remember, the policy gently suggested that
"handicapped" kids be encouraged to sit "near the front of the bus"
but it did not demand that all "handicapped" kids *must* sit there.
More critically, it was just a local policy, not a law passed by a
legislative body. My dad and I talked to the driver and he did
ultimately back down and let me sit wherever I wished on the bus. My
point in telling this whole tale is that oftentimes powerful people
may try to intimidate us by overstating their authority to
discriminate (i.e. by claiming discrimination is built into the law).
Getting written copies of these kinds of statements will help us be
savvy about where discriminatory policies come from and whether they
actually hold up under the law. We can use this information to make
informed decisions about whether, or how, to take formal action.
