The answer to both of those questions is design. Website developers focus on what looks good to the consumer. They don't necessarily think about accessibility for those of us with visual impairments or blindness. That's why we need to educate them on how to make sure their website is both visually appealing and accessible. There are coding issues that make some sites break with ie8 or 9  but yet work with other browsers.
