I think you are trying to apply hard and set rules (which are by their nature
not hard and set)  from one set of circumstances to another, completely
different set of circumstances.

My only point here is that there is no free pass that says if you have a white
cane or a guide dog then you are safe and drivers are absolutely responsible for
your safety..

okay from what I remember studying for my lerner's permit and helping my
daughter's with hers, it seems to me that the person behind the wheel is
responsible for hitting a pedestrian whether by accident or god forbid on
purpose.  A driver can be sued in civil court for damages.

Now, I remember driving and you have to keep your eyes on the road as well as
what is around you at all times, to be a safe driver.  Now, we are saying now is
if someone walk out in the middle of the street whether it is at a cross walk or
not, because there is not always going to be a cross walk around and we have to
have to know our surroundings as well, listening for cars, etc when crossing the
street, and if someone steps out and walks let's say one of our member up in
albany and this is an actual case here in NY, A business owner vender in one of
our state office buildings was crossing the street at a cross walk with the
proper street crossing lights that have tweeting street signs to help them cross
and still he stepped off the curb with his can, and mind you it is one of those
famous quiet cars we are trying to change in congress that person who is
crossing the street is partly responsible.  Mind you he is okay, and only his
can suffered the damages, in fact when we go to Albany every year he brings the
damages cane with him to show all the senators and assembly people there.  That
makes him partially responsible.  I don't think so.
