In the state of Florida, this will be the law of the land, effective
July 1, unless either the house had the good sense to not pass it or we can
convince the governor of the error of the legislature's ways and get him to
veto it. Whether we have a snowballs chance in Florida to do this remains to
be seen. We will keep you posted on our efforts and progress.
As a matter of constitutional law, state's have the right to make laws
that offer broader protections, but may not make laws that are more
restrictive. In other words, since this law offers a broader definition than
federal law, it is not unconstitutional. If, on the other hand, the previous
implementing regulations in federal law defining a service animal as "any
animal" were still in effect, Florida could not say that a service animal is
only a dog.
