Maloney's Tavern owner agrees to settle civil rights complaint

The company that owns Maloney's Tavern in Albuquerque has agreed to pay a
$2,500 fine for refusing to seat a disabled woman with a service dog, the
U.S.
Attorney's Office said.
MasDonald LLC, of Scottsdale, Ariz., also agreed to train its employees to
comply with the Americans with Disabilities Act, the U.S. Attorney's Office
said in a news release.
According to a settlement agreement in the case, Maloney's at 325 Central
Ave. NW would not seat a woman with multiple sclerosis because she had a
service
dog when she entered the restaurant with a friend on Aug. 18, 2012.
The woman,
Susan M. Cash,
filed a complaint against Maloney's with the civil rights division of the
U.S. Justice Department.
"Once inside the restaurant, the bartender yelled at Ms. Cash across the
restaurant that she could not bring her dog into the restaurant and that she
could
sit outside," the settlement agreement said. "Ms. Cash responded that her
dog was a service dog and she had a right to dine in the restaurant with her
service dog. The bartender and other customers at the bar made comments
about having lost table space for a wheelchair ramp and made jokes about Ms.
Cash
having a dog to take care of her. The bartender insisted that Ms. Cash eat
outside or leave the restaurant."
As part of the agreement, Maloney's agreed to not discriminate against
disabled people and to display a six-inch by 12-inch sign near the entrance
door
that says, "This Restaurant Welcomes Customers With Disabilities Who Are
Accompanied By Their Service Animals."
The sign will also include the message in Braille.
Officials from MasDonald LLC were not immediately available for comment.
