[nagdu] Taxi Questions

Dear Marion,
Assuming you are correct--and I know you are--the driver then must
have his/her disability disclosed, so they aren't sent; if they don't, then
they have to transport, right?

Nicole,
What is not legal is for an entity to deny a benefit, provide an
unequal benefit, or provide a separate benefit. In other words, if a driver
is dispatched to transport you and refuses for most reason and offers to
call for another driver, this is an unequal benefit, as it is not the equal
benefit someone who is not accompanied by a service dog would receive. The
exception may be if a driver has a documented disability that would prevent
the transportation of a service dog, as that driver would also be covered by
Title I of the ADA and, as such, would be allowed a reasonable
accommodation. Such a reasonable accommodation would need to be requested
and provided by the entity.

Fraternally yours,
Marion Gwizdala

Okay, so, just to clarify, the answer to my third question about sending
another driver is that that is not legal?

	Dear All,
Not to be contrary but in an effort to be accurate, there is nothing
that prevents any entity from keeping a record that one has a service dog.
What is not legal is to deny a benefit or offer an unequal or separate
benefit because of the presence of the service dog. If this occurs, I would
encourage you get in touch with the National Association of Guide dog Users
(NAGDU) at 888-NAGDU 411 (888-624-3841) AND WE WILL HELP YOU file a
complaint with every enforcement agency at your disposal, as each offer
specific remedies and filing a complaint with one does not exclude filing
with another. For instance, if such a thing were to occur in Tampa, Florida
where I live, I would file a complaint with either the Tampa Police
Department or the Hillsborough County Sherrif's Office - depending on where
the incident occurred - since Florida provides criminal remedies for such
violations, the county's Public Transportation Comission that licenses cab
drivers and companies, the city or county civil rights office, the State of
Florida Attorney General's Office of Civil Rights, and the United States
Department of Justice. I would also contact the media to let them know about
the incident as a way of educating the general public.
I will share with you that such a thing will likely not occur in
Hillsborough County because these things have already been done. Cab
companies are aware of the penalties they would face because they have faced
them. As the result, they are doing a good job educating their drivers and
taking swift action when vilations occur!

no thay must take you and thay can't keep a record of the fact that you have
a guide dog. The ADA covers this and you can find a coppy of the law on
internet. Do not let them get away with this crap.

Forgot one.
4. Is it legal for a taxi company to record that a specific passenger has a
service dog?

I have a few questions about guide dogs in taxis.
1. Which law gives the rules on this?
2. Where can I find a copy of this law, and, if it is different for
California, the version relevant to California?
3. Is it legal for a taxi driver to not take a passenger with a guide dog if
the driver notifies the taxi company and the company sends another taxi?

Thanks,
Nicole
