[nagdu] the workplace and new dogs

Thanks Wesley; it is clear I need to read these, as my jobs have generally been helping people with disabilities of which advocacy and correct information is a part, so thank you for opening my eyes; guess Mr. Bush got such a bad rap for other things, the good things he did have been overshadowed.

I can't say many good things about ANY of the recent occupants of the White House but at least Bush supported our veterans. Veterans groups were the primary supporters of the amendment.

As for downloading a copy I'm not sure that the amendments would be included. Every site that I have seen expects us to download the amendments separately. I guess it would depend on what site you go to.

Thanks you, Wesley; at least I can say one thing good about Mr. Bush, but I don't know why I didn't see that; am I correct in that if I download a copy of the ADA now, that Amendment, and any others I don't know about would be there?

It's not case law although it has been upheld in court cases that were filed by veteran's advocates.

The provisions for service dogs for people with PTSD were written into an amendment to the ADA that was signed into law by George W. Bush before leaving office. As such the provisions are statutory law not case law.

Hi Wesley,

I wasn't being rude; I know case law changes many things, and I'm very glad for people with PTSD they have, but people in larger cities say they are running into a lot of uncontrolled "service" animals; I only put that in quotes, because nobody know, much of the time, where the animal was trained or if it was trained privately by someone who knows what they are doing.
I will go to that site, as I'm very interested to see the case law that broadened the definition.

Guess again. Helping me calm down from my anxiety and panic attacks is considered performing a service under the ADA and that has been enforced in court many times in the past.

Not under the ADA, unless you know something I do not.

Under the ADA and Fair Housing Act dogs which help people calm down from disabling anxiety attacks or panic attacks (or in Spike's and my case both) are legally considered service dogs.

In order for a dog to be considered a service dog under the ADA, the following must be met:

1. the person has to have a disability. this means some sort of impairment that interferes with tasks of daily living.

2. The dog has to be individually trained to do tasks or perform work that mitigate the person's disability.

So, yes, service dogs for PTSD can be legitimate service dogs if the handler's PTSD is severe enough to be considered to be a disability and the dog does something to assist the handler. I've read stories of dogs who go first into rooms to check for intruders or to turn on light switches. The person then feels at ease entering a new place, thus mitigating the disability. that's just one example, but you get the idea.

Hi everyone posting on this topic. I thought I now saw somewhere that PTSD dogs are now covered under the ADA. Perhaps I'm wrong though.
