[nagdu] Trying to understand: denial of access bad allergies

I'm honestly not sure what Uber is trying for. On the one hand, they have a policy that states drivers are expected to abide by all federal and State/local laws, including access to services by people accompanied by service dogs. A driver, they state, can have their contract pulled if s/he refuses to transport someone with a service dog. I suspect that this policy is not uniformly enforced, but i have no data on this. 

on the other hand, they claim in our lawsuit that the ADA does not apply to them. 

So which way is it?
