Jenine and Marion:

I agree, a stiff fine should be immediately charged.  The airline should be
allowed to refuse to permit a passenger with an out of control dog to board
the plane.  The same behavior expectations should also apply to guide and
service dogs.  I was on a flight to a convention many years ago when two
guide dog handlers with Fidelco shepherds that were extremely aggressive.
One of the dogs bit a flight attendant who was doing his best to protect my
golden from being attacked.  Any out of control dog should be removed from 
the flight no matter if it is a guide, service or emotional support dog. 
Also having up to date vaccination certificates does not have anything to do 
with the behavior of the dog.  However, in the case of the dog biting 
someone the proof of vaccinations would be very helpful for the person 
seeking medical treatment for the bites.  I think a
big part of the problem is that the airline staff is not really sure what to
do about out of control animals.  It would sure help if the ACAA would
restrict the types of animals allowed on flights to dogs just as the ADA
does.  Good luck to all of you involved with the airlines to ensure safe 
travel for guide and service dogs in the future.

Now, there's a fine idea that would curb the problem, provided the fine is
signifant enough and cannot be waived. Perhaps the first person who gets
stranded in an airport away from home because their ESA acted out would get
the word out about this!

I whole-heartedly agree with you, Marion. Also if an animal is out of
control in the cabin during flight, the animal should be required to be
transported in cargo for any remaining legs of that flight and a fine should
be levied against the owner.

The ACAA does not, by the nature of being a civil rights law, prescribe
penalties against individuals who violate its provisions. Itâ?Ts a law
designed to protect rights, not punish those who abuse rights/definitions.
