I'd be happy to do another talk about ABLE accounts. </div><div><br></div><div>We can do work, including Third Party Special Needs Trusts, for out-of-state clients provided they're able to come to our office in Delaware to sign. First Party Special Needs Trust--that's to say, trusts funded with the person with a disability's money, tend to be more state specific. While the rules have shifted over the years to allow for privately managed first party special needs trusts, I am reluctant to take that approach because eventually, after the special needs beneficiary has died, any balance remaining would need to be paid back to Medicaid. I'd be reluctant to put a civilian trustee in the difficult position of having to account to Medicaid.</div><div><br></div><div>For cases like those, I would typically direct the client to a "pooled fund" to act as trustee. Each state has at least one pooled fund as mandated by federal law. Delaware, since we're small, has only one--Delaware Care Plan.
