This case is an important reminder of the sweeping  protections for people
with disabilities under the Fair Housing Act.  Second,  The Fair Housing Act
disability discrimination claim was not about the landlord harassing a
disabled tenant but about the landlord’s failure to stop the disability
harassment by its tenant.  Please bear this in mind if you are harassed due
to your disability by other tenants.  Bring the complaint to your landlord
and document what actions, if any, the landlord takes.  Whatever the
landlord does, it must be effective in stopping the harassing behavior in
order to avoid liability.  Chris



Wisconsin Landlords Charged with Housing Discrimination for Allowing
Harassment of Tenants with Disabilities



The U.S. Department of Housing and Urban Development has

charged the owner and managers of an apartment complex in Cross Plains, WI
with violating the

Fair Housing Act

. Applewood of Cross Plains, LLC and the complex's managers allegedly failed
to stop several tenants from harassing their neighbor who has cerebral palsy

An d her daughter with Down’s syndrome. In one exchange, a neighbor
allegedly told the woman and her daughter: “You don’t belong here…You belong
in an institution.”

In another encounter, a resident allegedly told her daughter, “You shouldn’t
be out of your apartment during the day.”
