San Francisco, California (5 de febrero del 2010): Una corte federal tiene

gobernado que la Conferencia Nacional de los Examinadores de el Bar, (NCBE),
causará daño

irremediable a una diplomada de colegio de abogados ciega, a menos que le
proporcione

las comodidades basadas en la tecnología de la prueba que ella necesita para
tomar dos

exámenes requeridos de hacer por un miembro del Bar Estatal de

California. El tribunal publicó su acto en una orden que concedía a la
diplomada del colegio

de abogados, movimiento para el mandamiento preliminar, el jueves

4 de febrero del 2010. El acto del tribunal permite que la demandante,
Stephanie
Enyart,  tome en febrero del 2010, La Examinación del Bar Cluriestatal,
(MBE),

y La Examinación Profesional Cluriestatal de Responsabilidad, en marzo del
2010,

asistiva

El Doctor Marc Maurer, Presidente de la Federación Nacional de Ciegos,

dijo: "La Federación Nacional de Ciegos está extremadamente satisfecha con

el acto en este caso. La ley, y la equidad, sencillamente, no permiten a
NCBE dictar una solución única para todos los candidatos del bar

con discapacidades. Esperamos que este acto cause al NCBE  pensarlo por
largo rato, y fijamente, antes de que niegue las comodidades pedidas

de aspirantes para tomar sus examinaciones."

La demandante, Stephanie Enyart, dijo: "Durante hace poco más de un año,

envié mi primer pedido de las comodidades a MPRE, en marzo del 2009, y puedo
irme a dormir

esta noche, sabiendo, cuándo y cómo, puedo

tomar con eficacia los exámenes para hacer realidad mis sueños."

Annna Levine, de los Abogados de los Derechos de los Discapacitados, una
abogada que representa

a la demandante, dijo: "Espero que nuestra reñida victoria aquí

envíe un mensaje a las organizaciones de prueba que necesitan cumplir con

el Acto de los Americanos con Discapacidades, ADA, y proveer a cada

La demanda fué entabláda el 3 de noviembre del 2009, debido a la denegación
de NCBE,

en ocasiones múltiples durante el último año, de permitir que la señora
Enyart utilice

la misma tecnología en MBE y MPRE, que ha utilizado en

exámenes de la Universidad, y en el colegio de abogados, y en varios
trabajos y

puestos de interna. La demanda de que el NCBE violó el Acto de los
Americanos

con Discapacidades, (ADA), y el Acto de los Derechos Civiles de California,
Unruh,

negando comodidades en el MBE, y el MPRE.

NCBE, había sostenido que satisfizo sus obligaciones legales con la señora
Enyart

ofreciendo comodidades alternas, tales como un lector humano,

a pesar de evidencia que estas alternativas, de hecho,

no acomodan la discapacidad de la  señora Enyart. En rechazo de NCBE, en la
discusión,
