style='font-family:"Georgia",serif;color:#242424'>The Centers for Medicare and Medicaid Services released an interim final rule on Monday that outlined how states can manage exemptions to work requirements created under the 2025 One Big, Beautiful Bill Act. CMS will allow affected beneficiaries to self-declare that they meet exemptions for 2027 but will require them to present documentation to back them up by 2028.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='mso-margin-top-alt:12.0pt;margin-right:0in;margin-bottom:12.0pt;margin-left:0in'><span style='font-family:"Georgia",serif;color:#242424'>“This is far more than a policy prescription. This is our path to prosperity for the American people,” said CMS Administrator Mehmet Oz during a call with reporters on Monday.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='mso-margin-top-alt:12.0pt;margin-right:0in;margin-bottom:12.0pt;margin-left:0in'><span style='font-family:"Georgia",serif;color:#242424'>The One Big Beautiful Bill Act requires 40 states and the District of Columbia, which expanded Medicaid under the Affordable Care Act, to implement requirements for the expansion population starting next year.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='mso-margin-top-alt:12.0pt;margin-right:0in;margin-bottom:12.0pt;margin-left:0in'><span style='font-family:"Georgia",serif;color:#242424'>The rule defines which beneficiaries from ages 19 to 64 must meet the requirements.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='mso-margin-top-alt:12.0pt;margin-right:0in;margin-bottom:12.0pt;margin-left:0in'><span style='font-family:"Georgia",serif;color:#242424'>Affected beneficiaries must complete 80 hours a month of work, training, school or volunteering.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='mso-margin-top-alt:12.0pt;margin-right:0in;margin-bottom:12.0pt;margin-left:0in'><span style='font-family:"Georgia",serif;color:#242424'>There are several exemptions including for pregnant women, parents of children under 14 and people who are deemed medically frail. States can adopt other short-term exceptions including, for example, exempting a recipient who needs in-patient medical care.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='mso-margin-top-alt:12.0pt;margin-right:0in;margin-bottom:12.0pt;margin-left:0in'><span style='font-family:"Georgia",serif;color:#242424'>In the guidance, CMS defines medically frail as having a special medical need that significantly impairs the beneficiary’s ability to meet the work requirements.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='mso-margin-top-alt:12.0pt;margin-right:0in;margin-bottom:12.0pt;margin-left:0in'><span style='font-family:"Georgia",serif;color:#242424'>For 2027, CMS is calling on states to use existing data to document whether beneficiaries meets an exemption, including verifying medical claims that show they have disabilities that prevent them from working. If that data is not available, then the individual can self-declare that they have met the exemption.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='mso-margin-top-alt:12.0pt;margin-right:0in;margin-bottom:12.0pt;margin-left:0in'><span style='font-family:"Georgia",serif;color:#242424'>Several states have called for this approach because it is less costly for the state and less of a burden for beneficiaries.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='margin:0in'><span style='font-family:"Georgia",serif;color:#242424'>However, conservative health policy experts are loath to use this approach. Montana is expected to start its work requirement program in July and Arkansas will do a soft launch that implements the program the same month but doesn’t drop anyone off until January.</span><span style='color:#242424'><o:p></o:p></span></p><p class=skipproofing style='margin:0in'><span style='font-family:"Georgia",serif;color:#242424'>States are right now grappling with the costs of updating their systems to implement the changes.
