I'm very unclear from Gerri's message precisely what the board is going to
be voting on nex Friday. She sent me the same draft that was presented at
the college policy meeting, but then said in a later post that other
language will be considerred including provisions made by you and Fred.

It is very messy to be sure.

Frankly, if they vote on anything the language and construction of this
document and policies therein must be in final form for the public to know
precisely what they are voting on. In fact all the board needs to know as
well.

If they would actually read the Rehab Act and rules which I've sent in toto
to Gerri they would indeed know simply what is required in the policy and
what is not. They also would know what is optional.

Fred is on the right track on many of these things when he denotes the
difference between "may" and "shall".

You have been correct on your analysis as well.

Christine is correct in that much of this draft is too wordy and much of it
is just extranious fluff.

Jeanette Brown was correct as far as she went on citations related to the
Rehab Act though I am certainly correct on the timeline issue which the
Rehab Act calls "duration of services" and which is accommodated for on the
college side under Section 504 as "academic adjustments".

Again the sadly pathetic thing is that the CRCs in the agency are supposed
to be familiar with all aspects of the Rehab Act. Apparently they are not or
they are promoting willful violations and wish to act in arbitrary and
capricious manners. Moreover, they apparently think they can influence the
board to rubber stamp these violations especially relative to "duration of
services".

I hope all of this makes sense ...
