Dear Ms. Schmidt,

Might I also suggest that you make yourself intimate with the Rehabilitation Act of 1973 as Amended,  and particularly Titles V and VI. Title V goes to the civil rights of all people with disabilities and applies to recipients of federal funds. It is the grandaddy of the Americans with Disabilities Act of 1990 which is also at play here. Title VI goes to the establishment of Vocational Rehabilitation programs by, you guessed it the Federal Government.

All this information is on the internet.

Please also note that federal law trumps state law. That is in the "Supremacy Clause" of the United States Constitution and since the Michigan Commission for the Blind is also federally funded to the tune of 80 percent the "Spending Clause" is at play as well.

You might also, in reference to your reasoning behind the recent closed meeting of the Michigan Commission for the Blind Board meeting reference the Michigan Attorney General's handbook on the Open meetings Act and other relevant data including Attorney General Opinions that are right up on the Michigan Attorney General's web site. Oh, yes and you might also look at the same under the Michigan Freedom of Information Act and its relationship.

Ms. Schmidt, I may be a citizen who is blind, but I demand open government and I certainly demand a better understanding of the laws that created and bind MCB in its activities by the person who acts as its legal adviser.

  As you advise the MCB Board in direct violation of FOIA and OMA (re: Bradlee v. Saranac County) and as you don't seem to be intimate with the federal legislation that trumps state law. Then I highly suggest that you take this training module.

    All,

     

    Since there has been some confusion about the roles and responsibilities of the Michigan Commission for the Blind Board I have attached a training module for State Rehabilitation Council's which have similar obligations, roles, and responsibilities under the Rehabilitation Act as does our commission. I offer this as free technical assistance that should be well heeded especially given the fact that the MCB Board had an extraordinary  mostly closed session on May 3, 2010 to discuss among other things the actual role and responsibilities of the board. Moreover, from the public record it appears that Director Cannon has some issues with the "policy making" role, the information requirements to commissioners, and indeed the general public let alone RSA in these regards. And it also appears from comments made by Lehman Jones at the most recent meeting of MCB that he seems to think the Commission Board is purely "advisory". Those were very strange comments indeed from the effective head of the Designated State Agency made to National Federation of the Blind of Michigan President Larry Posont.

     

    But, as the saying goes, "Actions speak louder than words."

     

    Please feel free to use this training module as it, indeed is available to the public unlike the activities and critical documents of MCB including its RSA monitoring and other activities.
