Re: FOIA Request for Draft Minutes and Recordings

  Dear Mr. Harcz, Jr.:

This notice is in response to your August 31, 2010 request to the Michigan Commission for the Blind (MCB) for copies of records under the Freedom of Information Act (FOIA), MCL 15.231 et seq., which you describe as:

"the draft minutes of the August 27, 2010, MCB quarterly board meeting and the mp3 recordings on CD, or, as you did last time on a thumb drive of the August 28, 2010, meeting".

In order to determine the existence of any nonexempt information/records within the Michigan Commission for the Blind that might be responsive to your request (the draft minutes are not completed at this point in time) and as to the recording of this meeting, a search and examination must be undertaken. For this reason, it is necessary to extend the time for response, as permitted by section 5(2)(d) of the FOIA, through September 21, 2010, or sooner.

  Sincerely,

  Carla Miller Haynes, FOIA Coordinator

Re: FOIA/OMA Requests Draft Minutes and Recordings

Carla Haynes, Michigan Commission for the Blind, FOIA Officer

  (via e-mail)

  Dear Ms. Haynes,

I am writing today to request pursuant to obligations under the Michigan Freedom of Information Act and the Michigan Open Meetings Act the draft minutes of the August27, 2010 MCB quarterly board meeting. They may simply be sent, as in the past to my e-mail listed above as a Word attachment.

Again in the interest of open government and to meet the spirit of the Open Meetings Act I am puzzled as to why the draft minutes are not routinely posted to MCB's web site as I've suggested many times before. I would not have to bother you or staff with these requests if that sort of transparency took place.

In addition, as in the past I am requesting that you send me the mp3 recordings on CD or, as you did last time on a thumb drive of the August 28, 2010 meeting. in MCB's action plans and in other literature the archiving of these recordings was supposed to have been implemented on MCB's web site years ago. At least that was the professed promise of the Commission. I would not have to bother you with these requests if the archiving of these files was actually implemented for I would just access them online or download them for later review.

Regardless, I thank you for your past prompt responses to these requests and thank you in advance for your prompt response to this one.

  Sincerely,

  Paul Joseph Harcz, Jr.
