By the way sir, Jo Anne Pilarski is only the nominal Chair of the Michigan Commission for the Blind. She is not the "entire Commission". This is a problem with DELEG/LARA et all in not understanding PA 260 and more importantly the Federal responsibilities under the Rehabilitation Act of 1973 as amended as with all federal laws it, including the civil rights components instructed by Article V of the "equal protection and due process clause" of the 14th Amendment of the U.S. Constitution and the "spending clause" of same trumps your anal stuff here or should.
Now, sir you and MCB and LARA should go back to school on civil rights here and look clearly at the federal rules and regulations you derive your income from both directly and indirectly and of which you violate over and over again.
As an aside it makes me sad, truly sad sir that I stood for civil rights of African-Americans such as yourself to be all that you could be and for your civil rights even as a young teenager and then to watch you denigrate and violate my and other's civil rights, including persons of color with disabilities as you've clearly done over and over again.
Sir, don't you get it? Your rights and mine are intertwined.
Your arbitrary and capricious violations of the fundamental right to know is only exceeded by your abject ignorance of the plight of so many people of color who are abused by LARA, MRS, and MCB.
Sir, Don't you know from prior FOIA that the so-called "bullet proof drape and other security measures" were a re-action from Director Cannon and his lap dog Jo anne Pilarski to the multiple demonstrations from African-Americans who happened to be blind from Detroit the most under serviced population of this entire state because they had the mendacity to peaceably demonstrate for equity in services and basic "call backs" from ersatz counselors at least on a comparable basis as the "white part of the state"?
Oh, but no they were "uppity" and threatening. Just like I and others, or like NFB is uppity and supposedly "threatening".
OOh my what is the threat? Do any of us threaten violence? No, sir not a one.
And that most assuredly includes myself who has dedicated himself over decades to peaceful, non-violent, yet very firm and very assertive measures.
In fact I a white male who happens to be blind is a lot more likely to get appropriate services in documented form than say those poor folks who happen to be black and residing in Detroit and who are also blind!
Oh, Don't worry there are lots of Uncle Toms to go around sir!

As regards the denied portion of your request, the Department does not possess a line item accounting of the cost, interagency transfers, or third party vendor costs of the video recording of the June 17, 2011 MCB meeting. Thusly, pursuant to MCL 15.235, Section 5(4)(b) of the FOIA, we must deny this portion of your request; and certify that the public record requested does not exist in this Department.

BTW, what about the cost of the video recording. Is this something your office and/or LARA is otherwise absorbing? I ask now, Mario, specifically because Al Pohl has advised us that MCB is under a "HARD FREEZE" on our spending and hiring, meaning that we cannot spend any amount of money on anything not considered to be an expenditure essential to service delivery.
Please provide us with reassurance that we will not be charged for this service.

Hello Mario,
Something to consider regarding video productions by LARA is the accessibility requirements of the ADA and the Administrative Guide to State Government (which is inserted below and attached), specifically the requirements to provide captioning and audio description. The applicable language of the state guidance is:
"Video or Other Media Production:
Video or other media production produced or distributed by Departments will be made accessible through open and closed captioning, descriptive video, or other methods.
Video recordings intended for internal investigative processes or documentation such as depositions, video recorded inspections, etc. are not covered by this policy."
The ADA connection to these requirements can be found in the "Program Access" portion of Title II of the ADA, which requires that all programs, services and activities of state government must be readily accessible to and usable by people with disabilities.
I'm sharing this with you, Mario, because I believe that we can anticipate that a blind person who requests the video recording of our Commission meetings might insist that it be described and, further, we cannot charge anything for the cost of making it accessible because the ADA would consider that being tantamount to assessing a surcharge for access, which is prohibited. Fortunately, though, our media technology office has expertise in the art of audio description, perhaps more so than in any other department.
