Dear Mr. Arwood:

Below is another communiqué from the National Federation of the Blind list
serve.  It describes how a MCB client is being mistreated.  unfortunately,
this is not even close to an isolated incident.  The difference is that Ms.
Posont raised it in public where it can legally be discussed.  Mr. Arwood,
what is happening?  As I wrote to you a few days ago, regarding the video
recording of the Commission meeting, blind consumers of MCB are not creating
these problems, the agency is.  I think you are fairly new to Rehabilitation
law.  The law says that documentation, especially agreements with the
agency, must be provided in accessible formats.  The IPE (Individual Plan
for EMPLOYMENT)  is the central document that defines services and
responsibilities between consumers and the agency.  No more than you would
sign a mortgage or other important document without reading it should a
blind person be forced to sign an IPE which could affect her future.  Why
wouldn't this be done automatically, since it is, after all, an agency for
blind people?

Further, her counselor alleges that she failed to submit a document
regarding financial aid.  As you will observe, below, she did submit the
best version of the document that she possessed.  I believe it is the
requested document which is garbled by the computer.  Again, accessibility
comes into play.  For whatever reason the University sent her a mostly
incomprehensible document.  I did read through the mainly meaningless, to
me, code.  I could infer that this is a financial aid report from the UMD
(University of Michigan Dearborn).  Clearly she was doing her best to comply
with her counselor's request.  The mish-mosh contains her name, the name of
the institution, the words financial aid and various dates.

The below letter concerns the unfortunate, in my opinion, departure of
Commissioner Pilarski.  In her correspondence Ms. Pilarski compliments the
Commission for helping her to stay in her job.  If she had been served in
Detroit, the outcome may have been much different.  Many children would have
not benefitted from her quality teaching while she sat at home angry.  Ms.
Pilarski is an example of how quality services can make the world a better
place.

Now, here comes Donna Posont, a woman trying to start a new career and serve
blind children in the much needed area of science.  Science, Technology,
Engineering and Mathematics (STEM) are careers targeted as necessary to
maintain a competitive standing for our nation.  This is a goal which
contributed to my support for Governor Snyder's election and which I still
believe he holds.

Ms. Posont, a single mom,  is pursuing her education and doing what most
people (including MCB staff) knowledgeable in career counseling recommend,
that is, working in her field for the summer.  How can the Commission
encourage people to reach out for opportunities and then pull the rug out
from under them?  What is that?

The behavior of the Commission can only be characterized as abusive.  To
withdraw funding for Ms. Posont's summer job and her education because she
wants her IPE in an accessible format is not only abusive it is, I believe,
against federal law. Sooner or later no one is going to protect the Director
and the agency from these violations of the law.  Sooner or later, someone
who has the authority and also cares about running a quality agency will
take steps to assure compliance with the law and respect the dignity of MCB
clients.

Just as with the video incident, this is happening on your watch.  You
inherited this problem,, hopefully you will fix it before you own it.  There
are continual threats and innuendo coming from MCB and LARA about merging
MCB with MRS.  This is also a bullying tactic by state government to prevent
blind people from demanding good service.  We shall not be bullied or
intimidated.  We created Public Act 260 and we will defend it in the halls
of the legislature just as we have in the past.  If combined with MRS we
will continue to advocate, in the streets if necessary, for quality services
to blind people.  This is not a good use of our resources when simply
providing proper management to the MCB would resolve the problems.  As I
commented in my earlier message to you, we believe in the laws, the
authority of the Commission Board and we believe the staff and facilities
are of a good quality.  We are strongly advocating for quality training for
Commission staff.  Properly trained staff would not, likely, act in such a
manner as Ms. Posont's counselor.  I cannot blame only Ms. Posont's
counselor.  This apparent violation of the law is so fundamental to
rehabilitation practice I can only view it as a failure of training and
supervision.

As I respectfully requested in my last message to you, I would sincerely
appreciate an explanation of how you think the MCB is being well-managed.
Please take an objective look at things.  I believe you will conclude that
we have a point.  We are not infallible nor do we know everything.  We only
know the law and what we experience and draw our conclusions from these
factors.  if there is an alternative explanation, please let us know.

    hHi Joanne, This morning I was looking at this trail of my interaction
with MCB over the course of the last two weeks. I saw that I sent you a copy
while you were serving on the MCB board. If I were paranoid I would think
that my email pushed you to resignation. Since I am not paranoid nor suffer
from dellusions of grandour I doubt if i even offered the straw that broke
the camel's back. I am deeply saddened by your resignation though I totally
understand the decision. I never got to know you personally, but I have
admired you from afar for many years. I want you to understand that I
greatly appreciate the work and endless efforts you make to improve life for
the blind people of Michigan.I know that you are not personally aware of my
challenges with technology. I understood that you were also challenged and
finally took the step to grasp the knowledge and skills to continue your
career and then served endlessly to help other blind people in their quest
for independence. I am one of those people. I was always so afraid of
technology. I finally decided to jump off a cliff and dive back into college
life after more than thirty years. I knew I was putting myself in a sink or
swim position because I would have to embrace technology to be  successful
in college and career goals. That is wxactly what I did and have found
success in reentering the accademic world and studying in areas such as
chemistry and biology. These subjects were designated as too difficult for
me as a blind person in 1974. After my many years of living life as an adult
blind person I decided that this area of study should not be denied
availability to  me as a blind persson. I have faced worse attitudes than
those of staff and consumers in and outside of MCB though it saddens me that
this is the place where I am now finding the resistance. The MCB is refusing
to continue to fund my education this fall and also is refusing to fund my
continuing employment at Camp Tuhsmeheta. Since MCB will not determine my
future I will find a way to continue my education. I will also find ways of
sharing my love and understanding of nature with blind people in pllaces
such as the Birding by Ear classes that I started at the Environmental
Interpretive Center at the University of Michigan Dearborn. I did not mean
to make this letter about me, but to take this opportunity to privately and
publicly thank you for great contributions to me personally and the many
other blind people of Michigan that you will never even have the chance to
meet. Again thanks for making a differance  and blessings in this next part
of the journeyof life.
