Dear Sir,

 

I’m writing today to receive the draft meeting minutes of the quarterly MCB board meetings held in September. As a blind person and citizen I also request them in accessible format pursuant to obligations under the ADA, Title II and Section 504 of the Rehabilitation Act. Precisely they may be sent as either Word attachments and/or plain text enclosures to my e-mail address listed above as my computer “talks”.

 

As you know you are required to remit these documents under both the ADA, Rehab Act, the Michigan Open Meetings Act and the Michigan Freedom of Information Act in a timely and accessible manner.

 

What puzzles me is the lack of pro forma and affirmative actions in these regards. I have requested these over and over again. I have also suggested that MCB put these minutes up on its own web site affirmatively as well as posting them in a timely manner on the MCB 20-20 list serve. On the latter point you always seem to be able to post so-called “approved” minutes on the list serve personally.

 

Regardless, as I’ve informed you in the past MCB is again required to act affirmatively and not simply in an ad hoc and reactive manner under the ADA re: Tyler v. Manhattan.

 

This continual struggle to receive required information in such a simple manner is indicative of the battle waged daily by consumers and citizens in this state in effectively communicating the written word with the agency.
