I still have not received to this very date the requested, accessible minutes and two of the three years IRS 990s.

This is a gross violation of the timeliness provisions of the ADA and 504 Mr. Zelley.

Not remitting requested information in three months plus can hardly be considered timely by any measure.

These are fundamental violations of my civil rights sir!

I wish to have mediation and remedy on this and other issues including retaliation for requesting accommodations and for pointing out ADA/504 violations by the City of Flint and TDN at of all things the ADA celebration of July 27, 2012 at Kearsely Park.

  We have focused on 2011 and will complete the others as soon as we can. I wish we had the staff to respond in a more timely way. We are re-creating as fast as we can. 

  Again, we did not realize that the federal 990 forms were not accessible on the Internet until your request. It is a reasonable request that should have, but we did not know. We began researching for an accessible format from the IRS right away. Working to get you the 2011 next week.

      Joe, When you ask how do I become a director, I am assuming you mean board member. We do not have board openings at this time. All board member terms are active. We also have a waiting list of board applications. Your name can be added to that list if you are interested. 

      Our next board meeting is floating because of the drastic situation with MRS planning to enter into Order of Selection (OOS). OOS will have a major affect on our 2013 State agreements. Our response will likely require an emergency board meeting in October, but the date is not predictable right now.

      However, we will have our regularly scheduled board meeting on Wednesday, February 20th, 2013. We do not expect any delays or changes. Board members usually arrive at 12:30 pm for a lunch and the board meeting starts at 1:00 pm. You are welcome to attend that board meeting and I will put you on the public comment agenda if you wish to address the board. 

      If you want to communicate with them sooner, you may also write to the board via TDN and I can get your communication to all of them. 

      By the way, I am verifying content of the 990 accessible converted document now and expect to get it to you next week. The actual re-creation is completed. Mike

              We are using the accessible format that we researched and found so we do not have to rewrite all of the content (questions, columns, instructions, etc.), just add our particular 990 information. That is what we are working on now and will send to you as soon as we get it done. I think it will end up being a word document. Mike

                        As you undoubtedly know TDN is a Title III entity under the meaning of the law (Americans with Disabilities Act of 1990) as it engages in commerce and operates educational programs. 

                         

                        Moreover, it is subject to obligations under Section 504 of the Rehabilitation Act of 1973 as it is a recipient of copious federal funds including substantial infusion of funding from the U.S. Department of Education as it is indeed a Center for Independent Living.

                         

                        Moreover, such a large recipient of federal funds should be transparent in the public interest precisely as to how those federal funds are employed. This is a simple matter of public accountability of an organization employing public funds.

                         

                        I would appreciate a written and accessible response to this inquiry within three (3) working days.
