Note this was Ed Rodgers belated response to my request for minutes of the very last meeting of the MCB board. Note: he recognized the right to receive them under the Michigan Open Meetings Act, the ADA, and Section 504.

Now fast forward more than a year and this agency abuses foia to ddeny me minutes and other documents (or to charge me for them) including minutes/transcripts of the advisory board meetings (already produced) and of the Elected Operator's Committe meetings. Ditto for documents associated with those meetings.

Also Zimmer is involed in this directly as he was the one who signed of and I have those documents as well.

Moreover, BSBP/LARA abuse the "undue hardship" provisions of the ADA and 504.

Moreover, both are attorneys. Both have been sent rules and regulations and thus both are acting with not only willful indifference to my civil rights but maliciously and with malice of forthought.

Dear Sirs and Madame,

 

I am writing you today to request the entire draft meeting minutes of the last Michigan Commission for the Blind public meeting of September 21, 2012. As you know that was a required meeting under the Rehabilitation Act of 1973 and associated information related to these meetings are required to be made accessible and indeed kept under Title I of the Rehabilitation Act which funds the former commission.

 

As you also know the Americans with Disabilities Act of 1990 also requires that public information is made available to people who are blind in a timely and accessible format (re: Tyler v. Manhattan, and ADA, Title II, subpart e, communications).

 

As you also know the Michigan Open Meetings Act requires that minutes are kept for such public meetings and that "draft" meeting minutes must be remitted to the public within eight working days.

 

Thus, as a person who is blind I am requesting these minutes in my most accessible format which is to have them sent to my e-mail address listed above as either/or a Word attachment and/or plain text enclosure.

 

 

Failure to promptly respond is a violation of my known civil rights under the Rehabilitation Act and the ADA and is actionable.

 

Thus I do expect a prompt and accessible response to this inquiry and thank you for it in advance.
