It was from Dan and the following reference from the RS Act that DTMB (first 
execcutive order) could not be the State Licensing Agency for it was not a 
VR agency.....

(e) In any State having an approved plan for vocational rehabilitation 
pursuant to the Vocational Rehabilitation Act or the Rehabilitation Act of 
1973 (Public
Law 93-112), the State licensing agency designated under paragraph (5) of 
subsection (a) of this section shall be the State agency designated under 
section
101(a)(1)(A) of such Rehabilitation Act of 1973.

SEC. 3. A State agency for the blind or other State agency desiring to be 
designated as the licensing agency shall, with the approval of the chief 
executive
of the State, make application to the Secretary and agree--
