Update: Section 504 Lawsuit

SC Leaves "Texas V. Kennedy" Litigation

 

 

 

               We are thankful that South Carolina chose to remove itself from the Texas v. Kennedy litigation.

 

This lawsuit included multiple disability civil rights laws but specifically targeted Section 504, a cornerstone of disability rights. The case would have made it harder for people with disabilities to live in the community and threatened long-standing protections that keep disabled people out of institutions and ensure access to education, healthcare, and community-based services.

 

 

 

Simply put, this lawsuit is deadly to people with disabilities.

 

By stepping away, South Carolina made the responsible decision not to participate in an effort that would weaken disability civil rights. We appreciate the state’s choice to uphold the rights of people with disabilities and the principle of community living.

 

Community living is a civil right.

Disability rights are human rights.

Unfortunately, although South Carolina is no longer participating, this lawsuit remains active and threatens people with disabilities across the US.
