The Family and Medical Leave Act (FMLA) covers private-sector employers with 50 or more employees, providing eligible employees up to 12 workweeks of unpaid, job-protected leave in a 12-month period for specified family and medical reasons, among them the employee’s own serious health condition. First, major changes are under discussion regarding the waiver waiting list system for people on/desiring Medicaid home and community-based waiver services.  The Department wants to identify those who most need these services.  Under the proposed rule, county boards must assess the 40,000 people currently on waiting lists, and determine whether they have an immediate need, a current need, or neither.  People assessed to have a current need (an unmet need within 12 months) will be placed on the new waiting list.
