All,
An urgent update on the again-rescheduled argument in the Payan appeal
before the Ninth Circuit. The date has been moved to November 18, no
longer November 20 as mentioned below.
TO avoid confusion: the new hearing date/time/location is Tuesday morning,
November 18, 2025, at 9:00 a.m. PT (arrive by 8:30 a.m. to get through
security). The Pasadena courthouse, Courtroom 3, is located at 125 South
Grand Avenue, Pasadena, CA 91105

Subject: [NFBC-Info] Rescheduled Argument in Payan v. Los Angeles Community
College
As you may recall, a jury awarded over $230,000 to two of our blind
students because Los Angeles Community College discriminated against them.
The judge in the case has since incorrectly ruled that those students
should not receive their award from the jury. We have appealed that
terrible decision to the Ninth Circuit.
The hearing with the appellate judges is coming up in Pasadena. Let's send
a strong message to those judges that the blindness community cares about
this case. They need to know that it matters when colleges discriminate
against blind students. Letting LACCD off the hook without having to pay
real damages is insulting to our civil rights and will encourage more bad
behavior from colleges.
We'd like to see as many canes and service animals as possible in the
gallery observing the proceedings. It will also be a very interesting
debate among the judges and lawyers about the legal issues in the case. You
are guaranteed to learn something about your own legal rights. Please
promote the following at your chapter meetings and with groups in the
region.
