> Model legislation was included in the National Council on Disability’s 2012 Rocking the Cradle: Ensuring the Rights of Parents with Disabilities and Their Children report that urged states to revise child welfare processes and services to eliminate discrimination against parents with disabilities. There has since been a surge of activity on both the national and state level. The increase in state-level activity changes in child welfare and family laws is notable because state statutes largely drive child welfare and family law policies and practices. While advocates are eager to have legislation introduced and passed in their states, many have encountered significant resistance, resulting in few bills actually becoming laws.

> I am a researcher at Brandeis University in Waltham, Massachusetts. My current study seeks to understand the barriers and facilitators to the passage of laws safeguarding the rights of disabled parents. In other words, why are some states able to swiftly pass legislation while others face significant challenges? Findings from our study will inform the development of technical resources for advocates and legislators.
> The sampling frame for this study will include interviews with legislators, legislative staff, advocates, attorneys, and child welfare agency staff. The participants will come from states that have passed legislation or have legislation pending. Participants must be age 18 or older and speak English.

> This study will consist of in-depth one-hour telephone interviews with approximately 40 key informants (legislators, legislative staff, advocates, attorneys, and child welfare staff) who were involved with the passage of legislation concerning parents with disabilities in their state. All information will be confidential. Compensation will not be provided to participants. The study has been approved by an IRB at my university.
