<p>What role does the judiciary play in foreign policy and how does it relate to the legislative and executive branches is a central question in Joshua Kastenberg’s new book, <i>Goldwater v. Nixon: Foreign Policy, China, and the Resurgence of Executive Branch Primacy</i>. While the Supreme Court ultimately upheld President Jimmy Carter’s unilateral nullification of the Sino-American Mutual Defense Treaty with the Republic of China (Taiwan) which facilitated relations with the People’s Republic of China, Kastenberg situates the case in the context of 1970s exploring U.S. political, cultural, and judicial history and its broader meaning for U.S. foreign policy while also discussing the implications of the federal courts and their function in framing such decisions as political rather than constitutional issues.</p>
<p>Amidst a new SCOTUS term, join Manuscript Division senior archives specialist Connie Cartledge, historian Ryan Reft, and author Joshua Kastenberg on Thursday, October 19, at noon, for an illuminating discussion about foreign policy, the Supreme Court, and executive power.</p>
