A Bend veteran says he wants to bring awareness to service dogs after he
and his dog were asked to leave a store recently. 

 

James Darcy said Friday that a week ago, he encountered a store manager
who didn't want the dog there and called the police on the two. 

 

But it's not this specific example Darcy wants people to hear. It's more
of an awareness he says Bend needs about everything disability-related. 

 

"I depend on him, physically and emotionally, " says Darcy, who's been
together with his service dog, Ollie, for four years.

 

The veteran fell off construction scaffolding 18 years ago, resulting in
major injuries with his back, hip and leg.

 

Ollie, a certified service dog, helps him get around and provides
stability if he falls. 

 

"He's trained to help me get up," Darcy said, "and he's actually been an
anchor point and laid there and let me drag myself to a cell phone when
I went

down once and was semi-paralyzed."

 

Darcy is unemployed and shops at discount stores to get by. But last
Friday, at one of his regular stops, "I had seen a lady coming down the
aisle, and

being as Ollie weighs about 100 pounds, I was trying to get him out of
the way so he wasn't blocking, which he wasn't."

 

"The next thing I know is, we're involved in another issue involving my
animal."

 

Darcy even showed the employee, whom he had never seen before, his
service dog certificate and doctor's note - that by the federal
Americans with Disabilities

Act, he does not have to do - but that didn't satisfy her.

 

The police were called, but he says they only gave him an incident
number.

 

"For one, just stand back and watch." That's how Brady Remsen says you
can tell if a dog is a service animal versus a pet.

 

A volunteer with Central Oregon Resources for Independent Living, or
CORIL, Remsen is blind and uses his dog, Glenn, for his guide.

 

He's had similar run-ins, and says merchants need to know the law that
these dogs, marked with patches or not, are to be allowed anywhere a
regular customer

is, with no extra fees and no hassling.

 

"I'm tired of this small excuse. We are a larger city now," said Remsen.
"We are coming along, but we have a ways to go. The whole guide dog
thing is a

part of the ADA - it's just an awareness."

 

James Darcy says he wants to file an ADA complaint with the Department
of Justice. But both men say, maybe the better route is just simple
education.
