However, I believe that Nicole brings up an excellent point as the person is
not actually going to use or rely on the dog to get around while in the
pool.  This by itself, would be a reasonable explanation as why to deny
access to the pool for the dog.  I would also consider that the law does not
mandate any particular arrangements among condominium owners. You need to
look to the rules that govern the use of common areas in your particular
condominium building or complex. These rules are often called Covenants,
Conditions, and Restrictions.  The other option would be to contact your
local health department, but again, physically having the dog in the water
with you unless you can provide a reasonable explanation as to why you need
the dog to swim is a stretch.

                It seems Ken isn't getting the basics of our rights of
access; common areas in condos and subdivision aren't necessarily public--in
other words, not every Tom, Dick or Harry can swim in our pool--but I guess,
it is possible, if he could sway the association, they would allow his dog
into the pool, though I see no reason for it other than he seems to think
this is his ADA-given right.
