Marion,

Unfortunately, it is not so easy to remember these articulate 
arguments in the moment of crisis.

Sadly, Howard was let down by the NYPD officers in this case, which 
in my experience is atypical.

The good news is that officers have field supervisors and watch 
commanders who they can radio for advice on the law, and as Howard 
was not getting the support from the individual officers at the 
scene, he may have been able to recommend to the officers to check 
with their field supervisor or watch commander for a refresher course 
on the law.
