Although the ADA does provide a reasonable accommodation clause, the person claiming the need for such has to state it prior to an incident, not at the time of one. 

This means a Uber driver would need to have on file a medical statement that due to allergies he/she cannot transport animals. This is the same argument used by taxi drivers and I do believe, though I can’t cite it, that there is case law on this point. 

That being said, filing an ADA complaint with DOJ is prudent, even if it gets no results as it does add to statistics and can be used in other suits and complaints. 

So a driver pulling up and claiming allergies but having nothing on file with Uber to support this claim doesn’t wash.
