			Remember awhile back how I said that that many
drivers for Uber are not fully functional human beings? Remember too how
nobody liked that post.... until the bad behavior impacted one of you.

Although the ADA does provide a reasonable accommodation clause, the person
claiming the need for such has to state it prior to an incident, not at the
time of one. 

This means a Uber driver would need to have on file a medical statement that
due to allergies he/she cannot transport animals. This is the same argument
used by taxi drivers and I do believe, though I can't cite it, that there is
case law on this point. 

That being said, filing an ADA complaint with DOJ is prudent, even if it
gets no results as it does add to statistics and can be used in other suits
and complaints. 

So a driver pulling up and claiming allergies but having nothing on file
with Uber to support this claim doesn't wash.

Unfortunately, unlike Florida law, the ADA provides a loophole for
'reasonable accommodation', that they would argue as this driver claimed an
allergy and they picked me up with another driver. Florida law is much more
direct in that it provides for criminal liability for denial of service and
does not include the reasonable accommodation loophole.  The problem here is
trying to get local prosecutors to accept a complaint for prosecution.
