Hello Ted and all others,

Thank you for these eye-opening articles. I would like to comment on one of
the articles which outlines Rep. Jerry McNerney (D, point of view on
excessive ADA lawsuits. McNerney has proposed H.R. Bill 4719,)a bill that,
in my opinion, profiles a class of individuals; people with disabilities.
Furthermore, this bill, if passed, appears to put the Burdon of proof on
people with disabilities, including blind persons; not the offending entity.
Additionally, this proposed bill sets a standard unique to any other class
of individuals electing to exercise his or her civil rights through the
courts.

On the other hand, no one appears to be proposing bills to quell the
ambulance chasers and the slip-and-fall folks. Given the fact that the ADA
has been in place for almost 26 years, I have little sympathy for violators
of the ADA who claim ignorance of the law. I seem to recall a similar
California bill was proposed about 11 years ago. If I recall correctly that
bill, or proposed bill, was turned down by the Ninth Circuit U. S. Federal
District Court.

Thank you for this food for thought.

Lisa Irving
