Cooperative Cash Match Agreement

between

Department of Energy, Labor and Economic Growth/Michigan Commission for the Blind 

(hereafter designated DELEG/MCB)

and

Macomb Intermediate School District

(hereafter designated the cooperating agency)

 

The agreement shall take effect on 10-01-10 and continue until such time as it is terminated as stipulated below.

I.                     A formal cooperative relationship is created and agreed to by DELEG/MCB and the local public entity designated above to develop and deliver vocational rehabilitation services to persons who meet the eligibility criteria of DELEG/MCB.

II.                   Eligible populations are individuals with visual impairments which constitute a substantial impediment to employment and who require vocational rehabilitation services to prepare for, obtain or maintain employment, as defined by the Rehabilitation Act and its Amendments.

III.                 Services provided under this agreement are not the customary or typical services provided by the cooperating agency. Services described in Attachment A must represent new services that have a vocational rehabilitation focus or existing services that have been modified, adopted, expanded, or reconfigured to be a vocational rehabilitation focus. These services provided by the cooperating agency must be limited to applicants for, or recipients of, services from DELEG/MCB as specified in Public Act 260. Administrative procedures are also outlined in Attachment A.

IV.                 Local funds will be receipted as described in Attachment B.

V.                   Expenditures for vocational rehabilitation services and administration of these services are under direct control, and complete discretion of, DELEG/MCB, as specified in federal regulations Public Act 260.

VI.                 The parties further agree:

A.                  No individuals shall be denied service solely on the basis of age, disability, race, color, creed, sex, national origin, marital status, religion, ability or inability to pay therefore.

B.                   There will be no discrimination against any employee or applicant for employment with respect to tenure, terms, conditions, privileges of employment on the basis of age, disability, race, color, creed, sex, national origin, marital status, partisan considerations, residence, height, weight, or arrest record.

C.                   There will be compliance with Federal Civil Rights Laws (Section 504 of the Rehabilitation Act of 1973, Title VI of the Civil Rights Act of 1964), the Americans with Disabilities Act of 1991, and the Rehabilitation Act as amended, both in providing services and achieving employment of individuals with disabilities.

D.                  If any provision of this agreement is found to be in conflict with the federal or state law, that provision will be subordinate to the law. The other provisions of this agreement shall remain valid and binding.

E.                   All aspects of this agreement covered by confidentiality provisions of laws and respective agency policy shall be observed by both parties to this agreement.

F.                   It is understood by both parties that this agreement remains in force until such time as it is amended or terminated by either party. Provisions of this agreement may be amended by revision to Attachment A or B. with the signature of both parties, and such an amendment and its specification shall become a binding part of the agreement. This document and Attachments A, B, C constitute the entirety of this agreement; no other attachments are permitted.

G.                   Request for termination of this agreement shall be sent to the other party by certified mail, return receipt requested. Termination of the agreement shall be at the discretion of DELEG/MCB and become effective 30days following receipt of the Notice of termination (sent via certified mail, return receipt requested).

H.                  This agreement may be renewed each year. Changes in program goals and budgeting will be designated in Attachments A and B.

I.                     The full local contribution will be obligated first during the fiscal year in which the agreement was originated. Any federal portion of agency funds remaining will be carried forward to the next year and redirected to other RS programs, at the discretion of DELEG/MCB.

J.                    In the event this agreement is terminated prior to the end of the fiscal year, the un-obligated local portion will be returned to the cooperating agency within 30 days of the effective termination date.

K.                  Case service funds generated as a result of this resource sharing agreement will be directed by DELEG/MCB, cannot be restricted to any one vendor, and will be utilized to purchase goods and services in support of an individual’s employment goal identified in the Individualized Education Plan.

L.                   At the completion of the state fiscal year (or upon termination of this agreement), the parties agree to meet and evaluate actual program activities against the program goals specified in Attachment A. Effective performance under this agreement will be evidenced by completion of Attachment C, Annual Review, which will be forwarded to the DELEG/MCB Office of the State Director 45 days following the end of the State fiscal year. This attachment will become a part of the original agreement and will be binding on both parties.

VII.         Evidence of this agreement is reflected by the proper signatures on Attachment B.

I.          Narrative

The Department of Energy, Labor and Economic Growth/Michigan Commission for the Blind (DELEG/MCB) and the Macomb Intermediate School District (MISD) will work in partnership to provide career exploration, pre-employment training skills and transition services for school-to-work or higher education. These services will be specifically tailored to benefit secondary students who are legally and / or totally blind. These services are to provide the additional supports necessary for blind students to access and receive maximum benefit from the transition services offered to their sighted peers. Transition services are to enhance opportunities for legally and/or totally blind students to experience positive employment options allowing them to continue on to gainful employment or further education after high school.

 

II.        Referral Process

MISD teacher consultants for the visually impaired (TC/VI) will refer eligible students to the DELEG/MCB counselors to open a case and for inclusion into the program. Eligible students will be secondary level, legally blind students receiving vision services via the MISD.

The MISD TC/VI will provide the DELEG/MCB counselor with a current copy of the student’s annual review of planning and program progress, eye report, release of information form (including video/photo release), DELEG/MCB general client information for program development application and MISD vision services evaluation. This information will assist DELEG/MCB in understanding the student, as well as, provide documentation to assist in prevocational and vocational training considerations needed for DELEG/MCB service planning. Information will also be provided as to the scheduling of the IEPT so that the DELEG/MCB counselor may attend the IEP and initiate a DELEG/MCB file and authorize participation into these partnership transition services. 

 

Legally and/ or totally blind secondary students may be eligible for referral for these transition services anytime after the age of 14 when their eligibility for transition services begins per the IDEA. By mutual agreement, a student’s participation in these specific partnership transition services may be delayed until it is determined the student will gain benefit from participation. 

 

III.       Joint Planning & Documentation of Cooperative Efforts

(A)         DELEG/MCB

 

1.                  The DELEG/MCB counselor will review the referral materials.

2.                  The DELEG/MCB counselor will complete the DELEG/MCB intake process, contacting the parents/students within 60 days after receipt of the intake materials, establishing eligibility for services.

3.                  DELEG/MCB will participate in IEP and transition for students as requested by the MISD TC/VI and/or the student’s school. 

4.                  Provide the family with written information regarding available programs and services through DELEG/MCB.

5.                  DELEG/MCB counselor will obtain medical report/physical exam from family.

6.                  DELEG/MCB will arrange any special evaluations necessary for the student to pursue program goals.

7.                  In partnership with other agencies, DELEG/MCB will provide each transition student the soft skills curriculum that prepares individuals for the following activities: adapted job seeking skills, resume preparation, mock employment interviews, application completion, job decoding, job shadowing, problem solving, mobility and transportation. Opportunities for summer employment will be offered to appropriate transitioning students for the development of work skills. A transition skills portfolio will be kept for each student documenting skill acquisition. Information regarding vocational training, as well as information regarding area colleges and universities will be provided to assist students in planning future program and career goals.

8.                  Arrange inclusion in the appropriate partnership secondary transition program once a student reaches high school level.

9.                  Upon completion of their educational program, DELEG/MCB will provide students with any vocational assessments necessary for job training, job placement or college assistance.

 

(B)         MISD

 

1.                  MISD TC/VI will provide the referral materials outlined in the referral process to the DELEG/MCB counselor for all eligible secondary students on their caseload. 

2.                  MISD TC/VI will invite the DELEG/MCB to the IEPT meeting of these students by the 14th birthday of the student.

3.                  MISD TC/VI will work in consultation with the DELEG/MCB to identify and place the student in the appropriate partnership transition program.

 

IV.       Feedback Mechanism

 

1.                  Parents/guardians will receive updates regarding progress within the transition program (including any employment roadblocks that are disability related) via the IEP process, as well as attend the established bi-annual parent night.

2.                  Ongoing collaboration and dialogue will occur between DELEG/MCB, their collaborating agencies and MISD TC/VI staff to monitor and assess this partnership transition program.

3.                  A transition skills portfolio (written, audio, visual, video or any combination) will be developed annually for each student by the skills provider to document skill acquisition. This portfolio will be shared with and housed by the local district to be part of the student’s permanent school record.

4.                  An annual Program Review Report will be issued by DELEG/MCB that will identify the goals of the participants and progress made toward achieving the goals.

 

 

V.        Evaluation of Program  Goals and Objectives/ Outcomes

 

1.                  Annual review of the program will be performed by DELEG/MCB, MISD TC/VI and any agencies contracted to provide transition services.

2.                  Annual review of student skill portfolios.

3.                  Review of annual DELEG/MCB Program Review Report.

VI.       Process For Resolution of Conflicts

 

Any conflict that arises will be resolved between the DELEG/MCB counselor and the MISD TC/VI. Any conflict that cannot be resolved at that level will be taken to the DELEG/MCB Regional  Manager and the MISD supervisor of vision services. Any conflict that cannot be resolved at that level will be taken to the Director of Consumer Services (MCB) and the MISD Associate Superintendent for Special Education Services.
