[blindlaw] Victory at the 6th Circuit for Blind Voters in Ohio

Today, the Sixth Circuit Court of Appeals reversed and remanded a case
brought by the NFB and certain blind voters in Ohio. The case sought
to implement the independent ballot marking system developed in
Maryland in Ohio by alleging that Ohio's current paper ballot system
violates the ADA. The Sixth Circuit held that the District Court erred
in granting Ohio's motion for judgment on the pleadings because the
determination of whether implementing the new system represented a
fundamental alteration to the Ohio voting scheme was a question of
fact that the district court should have developed through expert
testimony and evidentiary hearings. Here is a link to the opinion.
