This is a great question. My best guess is that a person could likely
argue that someone has such a right under the ADA, assuming the
accommodation is reasonable, obviously. I don't imagine, for instance,
that it would be a reasonable accommodation to video your fellow
patrons in a public gym lockerroom.
I do not, however, think that equal protection has been stretched far
enough to even create a whiff at a constitutional right. And nor do I
imagine any such right will be read into the Constitution any time
soon, no matter how pursuasively argued.
