[humanser] Counseling Jobs and Driving

I have faced this same problem as you guys. In fact, Jonathan sounds
exactly like me about three years ago. I too, have a Master's Degree,
though not as much experience. I too, have contacted offices on employment
who have told me it is legal. I worked for my local Center for Independent
Living for the past 2 1/2 years, where I learned about disability rights.
This has encouraged me to fight the system. I had given up because it's
just too hard to fight. However, I now find myself unemployed, so I guess
I've got nothing better to do with my time and nothing to really lose. It
still seems like a lot of work, and hopefully I will get the strength to do
it because it's not just for me. The ADA says that the person has to be
able to perform the essential functions of the job. They do not have to be
able to perform the minor functions of the job, as these could be assigned
to someone else as a reasonable accommodation. If there is nothing in the
essential functions that would indicate driving is necessary, then it is
discrimination under ADA law for a company not to evaluate your suitability
for that job based on not having a driver's license. Now that I am armed
with this information, the question for me is; how do I use it? Anyone want
to help create some case law with me? SMILE! I have been so discouraged by
my experience in the counseling world, I am considering going in a different
direction. I just don't know what that is yet.
